인권의 학습자를 넘어 인권의 교육자와 조력자로서의 기업

국문 초록

신자유주의 경제의 대두, 급속한 경제 발전 그리고 세계화의 확산으로 기업의 경제적인 영향권은 물론 사회적인 영향권 또한 크게 확대되었다. 이러한 사회적인 영향권 하에서 기업들은 노동권과 비노동권에 걸쳐 거의 모든 측면에서 인권에 영향을 주고 있다. 그 만큼 인권 보호와 증진에 있어 기업 들의 역할이 중요하다. 그 동안 기업과 인권에 관한 논의는 상대적으로 많은 주목을 받지 못했으나 최근 기업들의 사회적인 책임에 대한 요구가 증가하면서 기업들과 인권에 대한 관심 또한 커지고 있다. 보통 인권 존중이라 하면 소극적인 의미의 ‘해 끼치지 않기’로 이해되나, 본 논문은 이러한 소극적인 의미의 인권 존중을 넘어 기업이 적극적으로 인권의 증진을 위해 노력해야 한다고 보고 있다. 기업들이 인권과 매우 밀접한 관계를 맺고 있는 만큼 기업 들을 대상으로 한 인권 교육이 시급하며 여기서 한 걸음 더 나아가서 기업은 수동적인 학습자가 아니라 인권의 교육자와 조력자가 되어야 한다. 이에 본논문에서는 인권, 윤리 경영, 지속가능경영, 사회적 책임(Corporate Social Responsibility “CSR”) 교육과 관련된 다양한 사례들을 참고하여 효율적인 기업 인권 교육 방안을 제시하고자 한다. 나아가 사례 분석과 폭넓은 문헌 연구를 통해 기업들이 어떻게 교육, 문화 CSR 활동과, 회사 내 인권 실천, 민관 협력 (Public Private Partnership)을 통해 인권의 교육자와 조력자가 될 수 있는지 고찰하고자 한다. 이와 같이 본 논문은 광주 인권 헌장과 인권 연구에서 상대적으로 덜 주목받고 있는 영역인, ‘기업들이 인권 수호에 있어 주체적으로 감당해야 할 역할’의 당위성을 제시하고, 구체적인 역할 수행 방법론을 제안하여 인권 연구의 저변 확대에 기여하고자 한다.

영문 초록

Rapid liberalization, globalization and economic growth have led to the increase of both the economic and social influence and power of corporations. The social power and influence causes corporations to affect human rights in almost every aspect of their businesses. Because of this and their enormous and global social power the role that corporations play in relation to human rights is of great importance. Until recently, the role and social power of corporations have been little acknowledged but now there is a strong demand for corporations to be socially responsible and the relation between businesses and human rights are of increasing interest. Normally when human rights protection is mentioned it is mostly considered as “not doing harm”. However we assert that it is imperative that corporations go beyond this passive definition and play a more active role. As corporations and human rights are closely linked together and therefore businesses need to receive human rights education (HRE) and going beyond HRE need to vibrant activists for human rights. This paper analyzes various cases and examples of not just human rights but other similar areas such as business ethics, sustainable management and CSR and seeks to propose effective methods of corporation HRE. In addition based on an extensive literature survey seeks to propose methods such as PPPs and educational and cultural CSR so that corporations do not rest as passive students of human rights but become teachers and facilitators as well.
