성전환자의 권리와 정체성을 통한 ‘나’ 됨을 위한 연구

국문 초록

성소수자란 동성애자와 성전환자를 포함하는 의미로 사용된다. 그러나 동성 애자는 본인의 성적 지향에서 비롯되는 것이고, 성전환자는 성 정체성에서 기인 하는 것이다. 이들은 사회에서는 물론 심지어 성소수자 내부에서도 소수이다. 의학계에서는 성전환증을 성정체성장애라는 정신질환에서 기인하는 일종의 질병으로 파악하고 있다. 대법원 또한 정신질환성에 대한 전제를 바탕으로 성전환자의 호적상 성별 변경에 대해 매우 엄격한 요건을 제시하고 있다. 뿐만 아니라 다양한 젠더 개념을 인정하지 아니하고 이분법적 성역할론에 근거하여 성별 변경 요건을 설시하고 있다. 병원에게 성전환자는 좋은 돈벌이 수단이다. 성전환자에게 성전환시술은 필수적인데도 불구하고, 전체적인 시술은 굉장히 긴 기간 걸리는데다가 정신 과, 내과, 외과를 모두 거쳐야 하는 대 시술이다. 물론 비용도 많이 든다. 경제활동을 영위하는 데도 불편함을 감수해야 한다. 예금통장을 만드는 소소한 계약을 포함한 신분증을 요구받는 모든 행위는 언제나 성전환자를 위축 시키고 이는 경제적 지위를 불안하게 만든다. 결국, 호적 변경이 어려움으로 인해 피고용자로서의 지위를 악화시키고 이는 성전환시술비용 마련에 난항을 겪게 하여 결국 직업을 구함에 있어 신분증 요구를 하지 않으며 평균소득은 더 높은 유흥업소로 성전환자들을 몰아낸다. 이런 구조적 문제를 타파하기 위하여 첫 번째, 자생적인 성전환자인권단체의 설치와 발전을 제안한다. 두 번째, 입법적 활동이 필요하다. 국내외에서의 입법시도 등을 바탕으로 성전환자와 관련한 법안의 입법에 반드시 필요한 사안을 점검하고 궁극적 모델을 살펴본다. 이런 대안들은 권리침해의 방지와 구제의 차원이다. 그러나 이러한 시도들은 성전환자가 온연히 ‘나’로 살 수 있는 세상, 즉 자신의 권리와 정체성을 되찾아가야 하는 사회가 아닌 애초부터 자신의 권리와 정체성을 스스로 누리는 사회의 밑거름이 될 것이다.

영문 초록

LGBT is an initialism referring collectively to lesbian, gay, bisexual, and transgender people. Lesbians, gays and bisexuals rely on their sexual preference, whereas transgenders involve their sexual identity. Transgender people are even the minority among LGBTs as well as in a society. The medical field argues that a transgender symptom is regarded as a mental disorder of sexual identity. A Supreme Court also restricts the correction of gender fixed in a birth certificate. Also, the court suggests a certain limited condition for correcting the gender in a birth certificate based not on the diversity of genders but on the dichotomy of gender role. Hospitals are able to make a huge fortune with transgendering surgical procedure. Though the procedure is inevitable, it takes a lot of fortune. On top of that, it takes a lot of time for the procedure, and the procedure includes psychiatry, internal treatment, surgery, etc. Transgenders tend to be treated unfair in a career. Whenever they are required to show their ID card, they are reluctant to do it, which results in suffering from their economical difficulties.Eventually, the limits of the correction of gender in a birth certificate deteriorate their social status, which triggers transgenders having an illegal job with better pay and no ID card requirement. In order to overcome the issue, it is necessary to establish organizations for transgenders. Second, lawmaking process is required. As an attempt to legislate, I would like to figure out some essentials for legislation related to transgenders in the thesis. These measures prevent the violation of transgenders right. Besides, the measures are not for the society in which transgenders should find out their right and identity but for the society in which transgenders enjoy the right and their identity from the beginning.
