국문 초록

2011년은 한국에 국가인권위원회가 설립된 지 10년이 되는 해이다. 십년이면 강산이 변한다고 할 정도로 짧지 않은 시간이기에 그 변화에 맞게 국가인 권위원회가 제 역할을 하고 있는지를 돌아보고 성과와 한계를 점검해야 하는 때이다. 하지만 지금 한국의 국가인권위원회의 현실은 그러한 논의를 하기도 전에 존립 위기에 처해 있다. 국가인권위원회에 대한 비판은 내부 구성원들 만이 아니라 시민사회에서도 끊임없이 이어지고 있다. 2010년 11월 1일 국가인권위원회 두 명의 상임위원이 동반사퇴를 했다. 이는 국가인권위원회의 독립성 훼손 정도가 심각하고, 정부의 눈치를 보며 인권위를 운영을 하는 상황이 바로 독립성 훼손이며, 그 독립성 훼손을 주도하고 있는 현병철 인권위원장이기에 그의 사퇴를 요구하는 행위였다. 이어서 인권시민단체들의 현병철 인권위원장 사퇴촉구 농성이 시작되고, 67명의 전문자문 상담위원이 사표를 제출했다. 해마다 국가인권위원회가 세계인권선언 일에 맞춰 주는 인권상을 거부하는 수상자들이 속출했다. 국가인권위원회 독립성 훼손은 이명박 정부 출범 이후 지속된 정책기조라고할 수 있다. 2008년 초 대통령 인수위 시절 시도됐던 대통령 직속기구화 시도, 2009년 인권위 조직축소 및 조직개편, 그리고 현병철 무자격자 임명까지.본 글에서 이러한 국가인권위원회의 독립성 훼손이 국가인권위의 주요 인권침해에 대한 결정과 권고에 어떠한 변화를 주었는지를 평가하고, 독립성 훼손을 보완할 제도적 방안에 대한 모색을 하도록 하겠다. 이명박 정부 출범이후 인권위는 조직축소와 무자격 친정부 인물의 인권위원 임명으로 독립성 훼손이라는 위기에 처했고, 그 결과 알리바이기구화 되어가고 있다. 이를 추적하는 일은 이후 인권위의 향방과 인권운동의 과제에 매우 중요한 영향을 미치기에 독립성 훼손을 조직－인사－업무의 독립성 훼손이라는 세 가지 측면에서 살펴보았다. 인권위의 독립성 훼손의 결과 인권위는 국가권력의 인권침해 감시와 견제 기능을 하지 못했다. 우선 표현의 자유와 관련한 인권침해에 대해 어떠한 논리와 방법으로 침묵하였나를 짚어보았으며, 정부의 주요 정책기조에 대한 인권적 검토를 외면한 부분을 짚어보았다. 이러한 현실에서 권력으로부터의 인권위 독립성을 제도적으로 보완하는 최소한의 내용을 제안하고자 한다. 지금 국회상황으로는 제도적 보완조차 쉽지 않지만 조직－재정－인사의 독립성을 높이는 방안의 법 개정을 발의하고 사회적 공론화를 불러오는 일은 필요하고 중요한 일이다. 물론 법 개정만으로 인권위의 독립성이 확보되는 것은 아니다. 하지만 국가인권위원회의 설립이 인권활동가를 비롯한 시민사회의 노력으로 만들어진 만큼 인권위를 지키기 위한 노력도 시민사회의 몫이기에 한계적이지만 그를 위한 노력은 지속적 으로 모색되어야 한다.

영문 초록

2011 marks the 10th year since the the National Human Rights Commission of Korea was founded. 10 years is a short period of time, so it is often said that 10 years can change mountains and rivers. Thus, it is about the time for us to look back to see if the National Human Rights Commission of Korea did perform the proper roles and assess the achievements and the limits. However, the existence of the National Human Rights Commissio of Korea is in danger, even before our discussing that. The National Human Rights Commission has been continuously being criticized by not only the internal members but also the civil society. On the Nov 1 in 2010, two standing committee members of the National Human Rights Commission of Korea resigned together. This was the action requesting for the resignation of Mr.Hyun, Byungchoel, the chairman of the committee who lead the undermining, because the undermining of the independence was serious and the state of running the National Human Rights Commission of Korea by having a regard for the feelings of the government was the undermining of the independence itself. In succession, there was the sit-in of human rights NGOs insisting the resignation of Mr.Hyun, Byungchoel, the chairman of the committee started and 67 expert members for advisory consultation have tendered their resignations. Each year, the awardees who refused to recive the Human RIghts Award given on International Human Rights Day appeared one after the other. The undermining of the independence of the National Human Rights Commission of Korea is the political stance persisted since the launch of Lee Myung-Bak s government. From the trial for making the body under the immediate control of President Lee in early 2008 during the presidential transition, the downsizing of othe National Human Rights Commission of Korea and the reformation of the organization in 2009, to appointing Mr.Hyun, Byungchoel who was not qualified. In this writing, how the undermined independence of the National Human Rights Commission of Korea influences the decision and the recommendation of the National Human Rights Commission of Korea for human rights violations, will be assessed and then the institutional schemes that will suppement that undermined indepence of the committee will be sought. Since the launch of Lee Myung-Bak s government, the National Human Rights Commission of Korea is in a crisis of the undermined independence because of the downsizing of the organization and the appointment of the unqualified person who was advocating the government, and as a result, the National Human Rights Commission of Korea becomes the body for an alibi. As tracing this greatly affects the future direction of the National Human Rights Commission of Korea and the object of Human Rights Movements, the undermining of indecence has been investigated in 3 aspects : organization - personnel management - the undermining of independence. As a result of the undermined independence of the commission, the National Human Rights Commission of Korea couldn t perform the function for checking and surveillance. Firstly, the logics and the means with which they kept their scilence about the human rights violation against the freedom of expression was addressed, and the parts that disregarded the reviews in terms of human rights with respect to the political stance of the government was addressed. In the reality like this, I wish to propose the minimum contents that will institutionally supplement the independence of the National Human Rights Commission of Korea from the power. In the state of the national assembly, even the institutional supplementation does not seem to be easy, but proposing of the amendment of laws that will enhance the independence of organizations - finance - personnel management, and publicizing them are important and necessary. Of course, the amendment of the law will not guarantee the independence of the National Human Rights Commission of Korea. H
