국문 초록

1948년 12월 12일 유엔총회 결의안 제2항 가운데 “this is the only such government in Korea”를 어떻게 이해할 것인가를 놓고 다양한 주장이 제기되어 왔다. 대개는 역사학적 해석보다는 정치적 도덕적 판단에 치우쳤다. 이 문장은 단순해보이지만 상당히 복잡한 내용을 포함하고 있다. 그래서 그 의미를 정확히 이해하기 위해서는 대한민국 정부의 수립과 승인 과정에서 미국이 취한 태도를 면밀히 살펴볼 필요가 있다. 미국은 대한민국 정부 수립의 발의자이고 주도적 지지자였기 때문이다. 미국의 기본 입장은 선거를 통해 구성된 대한민국 정부가 현실적으로는 ‘남한만’의 정부이지만 1947년 11월 14일 총회 결의안이 예상한 한국 전체의 ‘중앙정부(national government)’로서 간주될 자격이 있다는 것이었다. 하지만 관련 국가들 대다수는 미국의 주장에 공감하지 않았다. 그래서 미국은 위의 기존 ‘견해(view)’를 결의안에서 삭제하고 대신 반대 국가들의 입장까지 고려하여 “this is the only such government in Korea”를 추가한 미국-호주-중국 공동결의안을 마련했다. 1948년 12월 12일 유엔총회는 그것을 그대로 채택했다. 요컨대 “this is the only such government in Korea”에서 ‘in Korea’를 ‘한반도에서’로 해석할 사실적 법적 근거가 없다.

영문 초록

On December 12, 1948, the United Nations General Assembly adopted approving the conclusions of the report of the United Nations Temporary Commission on Korea and declaring in part “... and that this is the only such Government in Korea.” What does this “this is the only such Government in Korea” mean? Especially, for a political or ideological their stances, ‘in Korea’ of resolution have payed more attention to peoples in Korean society. First of all, it is necessary to trace closely the United State policy toward New Korean Government, because they were initiator and leading proponent of GA Resolutions on Korea. It was the ‘view’ of the United States Government that “the Korean Government established is entitled to be regarded as the Government of Korea envisaged by the General Assembly resolution of November 14, 1947.” But most of interested states(UNTCOK) as well as the United Kingdom were not agreed with the US’s attitude. They taken position that Korean elections were only provincial and not national in scope, and New Korean Government was not ‘national’ government. Thus, the United States dropped his ‘view’ of August 12, 1948, and accepted joint the US-China-Australia resolution, as mentioned above, “that this is the only such Government in Korea.” Taken together, it is not right to interpretate “in Korea” of United Nations General Assembly in part “this is the only such Government in Korea” as meaning ‘in Korean peninsula’, because of no factual, no lawful evidence either.
