국문 초록

본 연구는 미얀마 지적제도의 문제점을 도출하여 발전방향을 제시하는 것을 목적으로 하였다. 연구 결과 미얀마의 지적제도는 영국의 식민지 시대에 창설되어 법률체계, 행정프로세스, 기술 수준, 공무원의 마인드 등 지적활동에 문제점이 있는 것으로 분석되었다. 이에 대한 발전 방향으로 첫째, 지적 관련 법령 및 지적조사에 대한 규정이 명시되어 있지 않아 구시대 법령들의 개선과 함께 지적에 대한 단일법 제정이 필요하다. 둘째, 지적행정 체계가 조직적이지 못해 중앙과 지방에 지적 담당 전담조직 구성과 함께 대학에 지적학과를 개설하여 우수한 인재 양성이 시급하다. 셋째, 기술적으로 지적전산화를 추진하고 있지만, 경제력과 지적인프라 부족으로 한계를 드러내고 있어 최신 기술을 기반으로 지적조사를 전면적으로 실시하여 지적도를 재작성하는 것이 바람직하다. 넷째, 이러한 발전방향보다도 더 중요한것은 체제전환국에서 일반적으로 나타나는 토지의 무단 점유와 사유화, 이에 따른 지적조사 기피 현상을 극복할 수 있는 공무원의 지적제도에 대한 인식개선이 시급한 것으로 나타났다.

영문 초록

The purpose of this study is to investigate and analyze the actual status of Myanmar’s cadastral system, thereby deriving its problems and suggesting the direction of its development. For this, the temporal scope is set to a period from 1948, when Myanmar became independent from Britain, to the present, the spatial scope is restricted to Myanmar, and the contents scope is to derive problems from the actual status of Myanmar’s cadastral system and suggest the direction of its development. As for research methods, the literature review method and the Internet survey method are used together, and as for the analysis method, the descriptive analysis method is used. As a result of the study, it was found that first, it is necessary to enact a unified law regarding cadastre as well as to improve outdated laws and regulations because there is neither cadastre-related laws nor specific provisions on cadastral survey. Second, it is urgent to constitute central and local organizations exclusively in charge of cadastre, given the unsystematic cadastral administrative system, and to cultivate excellent talents by establishing the departments of cadastral science in universities. Third, in technical terms, the computerization of cadastre has been promoted, but reveals limitations due to economic ability and insufficient cadastral infrastructure; and so, it is desirable to re-draw cadastral maps by implementing cadastral survey in earnest, based on state-of-the-art technologies. Fourth, what is more significant and urgent than these directions of development is the improvement in public officials’ perception about cadastral system that can overcome the occupation and privatization of land without permission, which are commonly seen in economies in transition, and the resultant phenomenon of avoiding the cadastral survey.
