보안처분 중복부과의 제한원리

국문 초록

조문의 미비와 판례의 병과주의로 인해 보안처분은 아무런 제한없이 중복부과되고 있다. 이 논문은 그 정당화를 위한 제한원리로 비례성원칙, 보충성원칙의 관계 및 각각의 개념과 적용범위에 주목하였다. 그 결과 양 제한원리는 상보적으로 작동하며 보안처분 중복부과에 대한 하나의 대안이 될 수 있음을 주장한다. 먼저, 보충성원칙 관련한 주장이다. 첫째, 보충성원칙은 중북 부과되는 보안처분들의 투입우선순위 차원에서 선 작동하는 제한원리이다. 덜 침해적인 보안처분(들)만으로도 목적을 달성할 수 있으면 더 침해적인 보안처분(들)은 중복부과할 수 없다. 둘째, 보충성원칙의 개념은 소극적으로 이해될 필요가 있다. 따라서 형벌로 목적달성이 불가능할 경우에 한해 부과될 수 있다. 셋째, 보충성원칙은 형벌과 보안처분 간에는 물론 보안처분들 간에도 적용될 수 있다. 다음으로, 비례성원칙 관련한 주장이다. 첫째, 비례성원칙은 보충성원칙을 거친 후 남은 보안처분(들)의 각 처분적합성에 대해 작동하는 후 제한원리다. 둘째, 비례성원칙은 강화된 차원에서 각 세부원칙별로 엄밀히 심사해야 하며 이와 별개로 목적의 정당성은 형법적 차원에서 심사해야 한다. 셋째, 비례성원칙은 형벌과 보안처분 모두에 적용되는 형사영역 특별 헌법원리이며 다만 형벌에 대해서는 비례성원칙이 책임원칙으로 구체화될 뿐이다.

영문 초록

Multiple security-measures are imposed without any limiting statues or precedents. This study focuses on the limiting principle of proportionality and of subsidiarity to justify the overlapped imposition of security-measures. Both limiting principles of the subsidiarity and of proportionality are mutually complementary, so they can be a solution to the problem. At first, this article argues on the principle of subsidiarity. First, the principle of subsidiarity is a limiting principle to be applied in advance comparing to the principle of proportionality. More infringing security-measure(s) are prohibited to impose when less infringing one(s) can fulfill the purpose. Second, the principle of subsidiarity should be understood passively. They can be imposed only when punishment cannot fulfill the purpose. Third, the principle of subsidiarity can be applied not only to the relationship between punishment and security-measure but also to the relationship among security-measures. Next, this article argues on the principle of proportionality. First, the principle of proportionality is a limiting principle to be applied later comparing to the principle of subsidiarity. Second, the principle of proportionality should be applied strictly that subdivision principles are tested individually and the test of justification of the purpose should be individually reviewed in the perspective of criminal law. Third, the principle of proportionality as criminally specialized one is applied both to punishment and to security-measure. The principle of proportionality on punishment is specified and named as the principle of responsibility.
