북한의 헌정 개선을 위한 일 제언

국문 초록

북한의 헌정질서는 레닌주의 일당국가 체제와 김일성-김정일-김정은 유일지배체제의 양 축으로 구성되어 있다. 이 글은 후자의 부분을 분석하고 그에 대한 입헌주의적 개선을 기대하면 서 쓰여졌다. 북한 유일체제가 절대군주제와 비견될 수 있다는 점을 감안하여 그 입헌주의 개 선을 위한 참고사례로서 태국과 부탄의 입헌군주제를 검토하였다. 태국은 대체로 입헌체제 안정에 실패한 사례로 보았고, 부탄은 군주의 리더십으로 성공적인 입헌개혁을 진행 중인 사례로 보았다. 월터 배젓의 분석처럼 입헌군주제의 기본 형식은 존엄 부분과 실행 부분의 구분이다. 통상적인 정치과정은 민간의 권력기구들, 즉 의회, 행정부, 법원, 혹은 당과 정부에 의하여 수행토록 하고, 군주는 국가의 상징이자 국민의 대표자로서 예외적이고 궁극적인 권한만 행사할 수 있게 하는 것이다. 이글은 이와 같은 입헌군주제의 모델이 현재 북한 유일지배체제의 개선에 참고가 될 수 있을 것으로 보았다. 북한은 현재 존엄 부분과 실행 부분이 혼재되어 있어 존엄 부분에 과부하를 초래하고 실행부분은 무책임과 무능력을 야기하고 있다. 이글에서는 실행부분인 당-정 체제의 입헌적 개선보다 존엄 부분인 최고지도자의 비중과 역할에 초점을 맞추었다. 그리하여 국가 이념에 대한 비전 설정의 문제, 그 이념을 담지하고 체현할 책무 그리고 국가지도자로서의 공공성과 계몽의 덕성을 제시하여 보았다. 북한은 현재 변화의 기로에서 있다. 북한의 진로는 한반도 전체의 운명과도 직결되어 있는 문제이다. 북한 체제의 가능하고도 바람직한 미래에 대한 관심과 검토가 필요한 시점이고, 이 글은 그에 대한 하나의 탐색적 시도로 이해되면 좋겠다.

영문 초록

North Korea s political system consists of two axes: Leninism in the one-party state and the only ruling system in Kim Il-seong, Kim Jong-il and Kim Jung-eun. This article analyzed the latter part and expected constitutional improvement on it. In order to get some references for the improvement of the North Korean political system, this paper reviewed cases of constitutional monarchy in Thailand and Bhutan. While Thailand was seen as a failure to stabilize the constitutional system in general, Bhutan was regarded as a case of successful constitutional reform under the leadership of the monarch. Just as in Thailand and Bhutan, the basis of constitutional monarchy is the distinction between dignity aspects and efficient aspects. The usual political process is to be carried out by ordinary power organizations: parliament, administration, court, or party and government. Meanwhile, The monarch is to remain a symbol of the state, and as a representative of the people to exercise the exceptional and final power with the ultimate authority. This paper suggests that this model of constitutional monarchy could be a reference for the improvement of the sole-ruling system in North Korea. However, the study of the constitutional improvement of the efficient section of the party-government has been postponed. Instead, this paper focused on the supreme leader of the dignity section. This paper emphasizes the demand of a clear vision for the national ideology, the responsibility of the supreme leader to embody and embody the ideology, and the virtues of public interest and enlightenment of the royal family as a national leader. North Korea is currently at the crossroads of change. This is an issue directly related to the destiny of the whole Korean peninsula. The author thinks it is high time for concern and review of the possible and desirable future of the North Korean regime. This paper is an preliminary attempt for that purpose.
