국문 초록

현재 남북한 간의 관계가 발전적으로 개선되어 가고 있다. 이와 같은 시대적 상황에서 우리는 장래 어느 시점에 맞이하게 될 통일에 대비하여 남북한 간의 법제적 통합에 대해서도 보다 적극적으로 연구하고 검토할 필요가 있다. 따라서 현재 북한이 체결하고 있는 조약의 체계와 내용에 대한 연구와 분석을 바탕으로 그 의의를 파악하고 남과 북 상호 간의 관계에 적용할 수 있는 법제를 타진하며, 나아가 향후 통일의 단계에서 살피게 될 해당 조약들의 승계 여부에 대해서 미리 확인해 보는 작업을 하는 것은 상당한 의미가 있다 할 것이다. 본 연구는 이와 같은 차원에서 현재 UN에 기탁되어 있는 북한의 양자조약 중 투자보장협정과 이중과세방지협정에 대해서 우리의 조약과 비교하여 살펴보았다. 북한이 체결한 경제협정들은 그 체계와 내용면에서 모두 우리가 체결하고 있는 조약들과 상당히 유사하다고 평가할 수 있다. 대상 조약들이 체결된 시기의 북한은 외국인 투자를 적극적으로 유치하고자 노력하였고, 대상 조약들은 바로 이와 같은 북한의 변화된 시대적・경제적・정책적 요청을 그 배경으로 두고 있었던 관계로 곧 국제적인 표준적 전형을 따를 수밖에 없었던 것으로 생각된다. 결국 1990년대 이래의 북한의 대외적 경제협력에 대한 적극적 태도는 곧 현재의 변화된 모습의 단초가 되는 것으로서 일찍이 현재와 같은 북한 체제의 변화 방향을 나름 제시해 주었던 것으로 볼 수 있을 것이다.

영문 초록

Currently, the relationship between ROK(South Korea) and DPRK(North Korea) is progressively improving. In such an era as this, we need to study and examine the legislative integration between the two Koreas more aggressively in preparation for unification at some point in the future. Therefore, it would be meaningful to grasp the implications based on the research and analysis of the structure and contents of the Treaties currently concluded by DPRK, to examine the legislative system applicable to the relationship between the South and the North, and to confirm in advance the succession of Treaties which will be examined at the stage of unification in the future. In this regard, this study examines ‘Agreement on the Promotion and Reciprocal Protection of Investments’ & ‘Convention for the Avoidance of Double Taxation and Prevention of Fiscal Evasion with respect to Taxes on Income’ among DPRK s Bilateral Treaties deposited with the UN in comparison with ROK’s Treaties. The Economic Agreements concluded by DPRK can be assessed to be quite similar to the Treaties we have concluded both in terms of structure and content. At the time of the conclusion of the Treaties, DPRK actively sought to attract foreign investment. The Treaties seemed to have followed the international standard pattern because of the relationship with DPRK s changed historical, economic and policy demands. As a result, the active attitude toward DPRK s external economic cooperation since the 1990s is the beginning of the present change, and it can be seen that it suggested the change direction of the North Korean regime like the present.
