주민자치 제도개선에 관한 연구

국문 초록

주민자치란 영미에서 주권재민을 구현하기 위해 정립 발전한 제도로 그 핵심요 소는 주민의 자기입법과 자기통제에 있다. 정부는 1999년부터 읍 면 동 단위에서 주민자치를 실시하고 있다. 주민자치센터와 주민자치위원회 제도가 그것이다. 나아가 2013년부터는 풀뿌리자치의 활성화를 위해 주민자치회 제도를 시범실시하고 있다. 그러나 둘 다 읍 면 동 주민에게 자기입법권과 자기통제권이 부여되지 않아 명목상의 주민자치에 불과하다. 주민자치의 선진국인 미국의 타운은 우리나라와 달리 주민 스스로 자치헌장을 만들고 그 자치헌장에 따라 타운정부를 구성하는 방식으로 실질적인 주민자치를 구현하고 있다. 이에 미국의 자치헌장 제도를 개관하고 매사추세츠 주의 자치헌장과 타운정부 제도를 살펴본 다음, 그 구체적 사례로 매사추세츠 주에 속한 타운중 하나인 롱메도타운의 자치헌장과 타운정부를 개괄하고 우리에게 주는 시사점을 고찰한다. 한편, 최근 제주에서는 미국의 자치헌장 제도와 유사한 형태의 맞춤형 주민자치 고도화를 위한 시도가 풀뿌리 차원에서 전개되고 있다. 이에 그 내용을 소개하고, 주민발안과 주민투표에 관한 특례 필요성, 법인격 부여 여부, 자치권의 범위 등 그제도화를 위해 고려해야 할 쟁점들을 검토한다.

영문 초록

Residents autonomy is a autonomy system established and developed in England and America. The key factor of the residents autonomy is the self-legislation and self-control by the residents. Since 1999, the central government has been conducting resident autonomy in the eup, myeon, dong. The resident autonomy center and the resident autonomy committee system are the ones. Furthermore, from 2013, the local residents association system is being piloted to realize grassroots autonomy. However, the residents of Eup, Myeon, and Dong are not given the power of self-legislation and self-control, so they are merely nominal residents autonomy. In the case of the United States, which is a developed country of residents autonomy, the residents of the towns make home-rule charter by themselves and constitute the town government according to the home-rule charter. I would like to take a look at the home-rule charter system in the United States, and After examining the Massachusetts home-rule charter and the town government System, I reviewed the home-rule charter and the town government System of Longmeadow Town, one of the Massachusetts towns, and examined what implications it gives us. In Jeju, an attempt has been made to improve the residents autonomy similar to the home-rule charter system of the United States led by local residents. The contents are introduced, and the issues to be considered for institutionalization, such as the necessity of the Special regulations for the enactment of the ordinance and the referendum system, the legal personality, and the scope of autonomy, etc., are examined.
