국문 초록

우리나라의 지방자치제도는 1991년 지방의회 의원선거를 통해 제1기 광역 및기초 지방의회가 구성되면서 부활하여 지금에까지 이르고 있다. 지방자치의 실현을 넘어서 지방분권시대가 논의되고 있는 이 시점에서, 지방자치를 실현하는 본질 적인 부분 중에 하나인 자치입법권의 확대 및 그 역량강화에 대한 논의가 활발히 진행되고 있다. 자치입법역량 강화는 주민의 의견을 가장 근거리에서 듣고, 주민의 권리를 반영으로 이어질 수 있다. 이를 위해서 그동안 입법평가, 개인보좌관 등의 여러 가지 제도가 시도되었음에도 불구하고, 자치입법의 역량을 국가입법수준 으로 끌어올리는 데에는 한계가 있었던 것이 사실이다. 본연구는 자치입법의 역량을 강화하기 위해, 서울특별시의 경우를 중점적으로 살펴보고 그에 대한 문제점과 개선방안을 제시하고자 하였다. 먼저 서울특별시는 우리나라의 수도라는 점에서 하나의 지방자치단체 중 하나이면서 중앙정부의 파트너로서 기능을 가지고 있다. 또한 많은 인구가 밀집해 있으면서 생활환경이 복잡하고 다양하여 시민들의 다양한 요구를 반영해야한다는 특징이 있다. 따라서 주민들의 자치입법에 대한 요구가 급증하였고, 의회의원이 증가한 요구를 적극적으로 수용하면서 의회의원의 조례안 발의가 증가하는 결과로 이어졌다. 현재의 자치입법 역량을 고취하기 위한 과제로서, 자치입법에만 국한되어 문제를 해결하고 자한 접근을 들 수 있다. 자치입법 역시 국법의 일부라는 점에서 종합적인 차원에서의 접근이 필요했음에도 불구하고 자치입법에만 국한되어 문제를 해결하고자 할 경우 변화하는 입법환경을 반영하지 못할 수 있다. 또한 지방의회의 자치입법의 역량을 강화하고자 하는 해결책으로서 의원 개개인의 역량 강화만에 중점을 두었다는 한계점이 있다. 본 연구는 이러한 과제에 대한 대응방안을 의원 개별적인 차원에서의 지원과 지방의회의 조직적인 차원의 지원으로 나누어 제시하고 한다. 우선 의원 개별적인 역량을 강화시키기 위해서는 끊임없는 재교육과 연수 등을 할 수 있는 교육체계를 구축하는 것이다. 나아가 지방의회의 기능을 지원하는 연구센터 설립 등을 통해서 자치입법의 수요조사에서 입법까지 통합적인 조직 역량을 강화할 필요가 있으며, 국가입법과정에서의 참여와 대응을 위한 역량의 전문화가 동반되어야 할것이다.

영문 초록

The local autonomy system of Korea was revived by the election of local council members in 1991, and the first local councils and basic provincial councils were formed. At this point, beyond the realization of local autonomy, the age of decentralization is being discussed, Discussions about the expansion of self-governing legislative powers, which are essential parts of realizing local autonomy, and the strengthening of their capacities are actively underway. Strengthening the capacity of self-governing legislation can lead to opinions of residents in the nearest area and reflect the rights of residents. To this end, it is true that there have been limitations in raising the capacity of self-governing legislation to the national legislative level, even though various systems such as legislative evaluation and personal advisors have been attempted. This study aims to strengthen the capacity of self-governing legislation and the purpose of this study was to examine the problems of the Seoul metropolitan city and suggest ways to improve them. First of all, the Seoul Metropolitan Government is one of the local governments in terms of the capital of Korea and functions as a partner of the central government. In addition, the population is concentrated and the living environment is complex and diverse, reflecting the diverse needs of citizens. Therefore, the demand for the self-governing legislation of the residents increased rapidly, and congressional members aggressive acceptance of the increased demand resulted in an increase in the initiative of the legislative ordinance. As a task to promote the present self-government legislative capacity, the problem is limited to self-governing legislation. Although autonomous legislation is also a part of national law, access to a comprehensive approach may be necessary, but if the problem is solely confined to autonomous legislation, it may not reflect the changing legislative environment. In addition, there is a limit in that the emphasis is on strengthening the capacity of each member of the legislature as a solution to strengthen the capacity of local councils autonomous legislation. This study divides the countermeasures for these problems into the support of individual members and the support of the local councils at the organizational level. First of all, in order to strengthen the capacity of individual counselors, it is necessary to establish an education system that enables continuous re-education and training. In addition, through the establishment of research centers that support the function of the local councils, it is necessary to strengthen the integrated organizational capacity from the demand survey to the legislation of the self-governing legislation, and it should be accompanied by the specialization of competence for participating and responding in the national legislative process.
