지방자치 발전을 위한 자치경찰의 법적과제

국문 초록

중앙집권적 경향이 강한 우리나라는 1991년 지방자치제도가 부활되어 지방분권과 자치권의 보장이 강화되어 오고 있다. 2004년 지방분권특별법에서 자치경찰제 도입 하도록 의무화한 이래 2005년 정부의 자치경찰법안을 토대로 2006년 제주특 별법상에 자치경찰제도가 명문화되어 제주자치경찰에 의하여 민생치안이 유지되어 오고 있다. 그러나 제주자치경찰제는 교통, 환경, 관광 등의 분야에서 지역주민 맞춤형 지역경찰작용을 하여 오고 있으나, 지방자치단체장으로부터 독립적인 치안조직 체계의 부재, 실질적 자치경찰 사무영역 미흡, 자치경찰재정과 인력 부족, 위해방지 조치와 사법경찰권 부재 등의 한계가 드러나 있다. 특히 헌법 제117조와 제37조 2항에 의해 질서유지를 위해 주민의 복리사무중 하나인 주민치안서비스 제공과 주민의 생명 신체 재산보호를 하도록 입법적 조치가 요구된다. 또한 지방자치권의 본질적 요소의 하나인 자치권중 자치경찰권을 제주특별자치도에만 부여하고 다른 지방자치단체에 전면적으로 자치경찰권을 시행하지 않은 것은 헌법상 보장된 지방자치제도의 본질적 부분을 침해한다고 볼 수 있으므로 자치경찰법, 자치경 찰공무원법등의 제정이 시급히 요구된다. 문재인 정부는 자치경찰제 도입을 국정과제의 하나로 제시하여 자치경찰법을 올해 안에 제정하고, 점진적으로 자치경찰제를 확대·실시할 방침이다. 대통령 직속 지방분권위원회에 자치경찰제특별위원회를 구성하여 자치경찰법안의 마련하고 있다. 경찰청 개혁위원회에서는 광역지방자치단체의 자치경찰제를 전국적 확대 실시, 자치경찰본부와 시·도경찰위원회 설치, 자치경찰의 권한 부여, 자치경찰사무 범위 내에서 국가경찰과 자치경찰 협약을 통한 자치경찰작용, 시·도지사의 자치경찰 인사권 행사, 인력과 장비의 재정부담, 국가경찰과 자치경찰간의 협력 등을 자치경찰제 도입안을 제안하고 있다. 서울특별시는 전국단위 경찰청을 제외하고 그밖의 경찰기관은 자치경찰로 이관, 시 도지방경찰청과 시·도경찰위원회 설치, 보충성원칙에 의한 자치경찰 권한부여, 특별회계 또는 교부금 방식에 의한 재정지원 등을 제안하고 있다. 따라서 자치경찰제도의 의의와 자치경찰제도의 도입의 필요성, 제주자치경찰제동의 현황과 한계를 검토한 후, 경찰개혁위원회와 서울특별시의 자치경찰제도 도입안의 주요내용에 대한 비판적 고찰한다. 또한 지방자치발전 관점에서 자치경 찰법제 도입에 따른 법적문제, 즉 주민복리사무로서의 경찰의 개념 명확화, 광역 자치경찰제의 도입, 자치경찰권의 범위와 책임성 확보, 수사권 부여, 자치경찰교부세 도입 등에 대한 개선방안을 제시하여 마련하고자 한다.

영문 초록

In 1991, the local autonomy system was revived in Korea, which has a strong central tendency, and the decentralization and the guarantee of autonomy have been strengthened. Since the mandatory introduction of the autonomous police system in the Special Decree Law of Decentralization in 2004, based on the autonomous police law of the government in 2005, the autonomous police system has been stipulated in the special law of Jeju in 2006 and the public security has been maintained by Jeju autonomous police. However, the Jeju Autonomous Police System has been functioning as a customized local police in the areas of traffic, environment, and tourism, but it lacks an independent policing system from the head of the local government, , And the limitations of preventive measures and absence of judicial police rights are revealed. In particular, Article 117 and Article 37 (2) of the Constitution require legislative measures to provide the inhabitants peace service, which is one of the welfare affairs of the inhabitants, and to protect the lives, bodies and property of the inhabitants in order to maintain order. In addition, the autonomous police, which is one of the essential elements of local autonomy, is granted only to the Jeju Special Self-Governing Province, and the fact that the autonomous police rights are not enforced in all other local autonomous entities is considered to violate the essential part of the local autonomy system guaranteed by the Constitution. The autonomous police law, and the autonomous police officers laws are urgently required. Moon Jae-in Government is planning to introduce an autonomous police law this year as one of the national tasks and plans to expand and implement the autonomous police system gradually. The autonomous police legislation is being set up by forming a special committee for autonomous police system in the Presidential Decentralization Committee. The National Police Agency reform committee carried out nationwide expansion of the autonomous police system of the metropolitan municipalities, established the autonomous police headquarters and the city and provincial police committee, authorized the autonomous police, autonomous police operation through national police and autonomous police agreement , The autonomous police authority of the city and provincial governor, the financial burden of manpower and equipment, and cooperation between the national police and autonomous police. The Seoul Metropolitan Government is responsible for transferring to other autonomous police departments except for the National Police Agency, establishing a city and provincial police commission with city and provincial police stations, granting autonomous police authority under the principle of subsidiarity, financing by special accounting or grants Support and so on. Therefore, after reviewing the significance of autonomous police system, the necessity of introduction of autonomous police system, the current status and limitations of the Jeju Autonomous Police System, and the major contents of introducing autonomous police system in Seoul Metropolitan City. In addition, from the viewpoint of local self-government development, the legal issues related to the introduction of the autonomous police legislation, namely the clarification of the concept of the police as the welfare office of the residents, the introduction of the regional autonomous police system, the scope and responsibility of autonomous police rights, I would like to propose a plan.
