봉침 치료와 그 의료과실의 판단에 관한 소고

국문 초록

최근 30대의 한 여성이 한의원에서 허리 통증의 치료를 위하여 ‘봉침’을 맞은 뒤 과민반응으로 인하여 사망한 사건이 발생하였다. 봉침 치료에 있어서 벌의 침이 지니고 있는 독성이 염증과 통증에 효과가 있는 것으로 알려져 있다. 그러나 특이체질을 지닌 일부 환자에 대하여는 봉독은 과민반응을 일으켜 중한 장애를 남기거나 생명을 위협하게 된다. 그러므로 봉침 치료는 국민의 건강에 위해를 가져올 수 있는 행위이므로 의료인에 의하여 행하여져야 하는 의료행위의 성격을 지닌다. 동시에 우리나라의 의료기관에서 이루어지는 봉침 치료의 양태는 한의사에 의하여 약침의 방법으로, 의사에 의하여는 주사의 방법으로 이루어지는 것이 면허 범위 내의 의료행위로 파악되고 있다. 따라서 의료인은 봉침 치료의 전과정에서 주의를 해야 하며, 이는 시술 전 검사의무와 설명의무, 시술 중 경과관찰의무, 시술 후 지도의무, 응급상황에 대한 대처의무로 세분할 수 있다. 한편 봉독에 대한 과민반응으로 인체에 중대한 장해를 남기거나 사망을 초래할 수 있는 아나필락시스 쇼크의 경우 환자에게 내재된 체질적 소인으로 발현된다. 이러한 환자의 소인으로 손해가 발생하고 확대된 경우, 그 책임을 환자와 의료인 사이에 어떻게 부담지워야 하는지에 대하여도 검토가 필요하다.

영문 초록

Recently, a woman in her 30s suffered from a hypersensitivity reaction after a ‘Bee Acupuncture’ for the treatment of back pain in a oriental clinic. In the treatment of bee acupuncture, it is known that the toxicity of bee acupuncture is effective for inflammation and pain. However, for some patients with peculiarities, bee venom causes hypersensitivity, leaving some serious disorders or life threatening. Therefore, it is a medical practice that should be performed by a medical practitioner because it is an act that can bring harm to the health of the people. At the same time, the mode of the bee acupuncture treatment performed at the medical institutions in Korea is recognized as a medical action within the scope of the license, which is performed by the method of medicine by the oriental doctor and by the method of injection by the doctor. Therefore, medical practitioner should pay attention to the whole course of bee acupuncture treatment, which can be subdivided into the obligation to observe and explain before the procedure, obligation to observe during the bee acupuncture procedure, obligation to supervise after the bee acupuncture procedure, and obligation to cope with emergencies. In the case of anaphylactic shock, which is caused by a hypersensitivity reaction to bee venom, which may cause major damage to the human body or cause death, it is expressed as an inherited constitutional disease. It is also necessary to examine how the burden of the responsibility between the patient and the healthcare provider should be borne by the patient, if the damage is caused or enlarged by the patient.
