국문 초록

2017년 국내 실험분야에 사용한 동물은 310여만 마리에 이르렀다. 우리나라에서 동물보호법이 시행된 지 10년이 경과하였고, 신약과 생활용품 등의 안정성 입증을 위하여 다양한 동물실험이 이루어지고 있다. 이에 실험 등에서 사용되는 불필요한 동물희생을 막아야 한다는 주장이 제기되고 있다. 또한 과학의 발전에 따라 동물실험을 대체할 수 있는 시뮬레이션 실험, 세포실험 등의 방법이 개발되면서 동물실험 만능주의는 지양되어야 한다는 주장이 강해지고 있다. 동물실험은 단순하게 실험자의 윤리성에만 기대할 수 없고, 이에 대한 적절한 규제도 필요하다. 현실적으로 동물실험에 대한 규제는 매우 부족하고, 정부와 정치권은 경제적인 이유로 동물실험 제도적, 정책적 개선에 소극적이다. EU에서는 동물실험보다 더 안전하고 과학적인 동물대체시험법을 연구, 개발하려는 노력들이 강화되고 있다. 또한 EU의 지침을 통한 법제화와 유럽사법재판소의 결정례를 통하여 구체화되고 있다. EU가 동물보호를 위한 우선적 활동으로 화장품 분야에서 실험동물을 금지하는 지침을 적용하고 있다. 본 논문에서는 EU의 동물보호에 관한 법적전개와 화장품 분야에서 동물실험을 금지에 관한 내용을 EU에서 제정한 지침과 유럽사법재판소 결정례를 중심으로 고찰하고자 한다.

영문 초록

Animals, which were used in experimental field at home in 2017, amounted to about 310 animals. It has been 10 years since the Animal Protection Law took effect in our country. But diverse animal experiments are under way for an inevitable reason such as proving the safety of new drug and household items. Accordingly, it is being raised the insistence as saying of needing to prevent unnecessary animal sacrifice of being used in testing. Also, with being developed a method such as simulation experiment and cell testing available for substituting animal experiment according to the scientific development, the opinion is getting stronger as saying that the almighty animal-testing principle should be sublated. The animal testing cannot have expectation simply for an experimenter s ethicality. Even the regulation appropriate for this is needed. It is a fact that the regulation on animal experiment is very lacking in reality, and that the government and the political circles are passive in the institutional and policy-based improvement of animal testing for a reason of economy and corporate freedom. EU is being tightened the efforts to research into, develop and carry out the alternative animal-testing method that is safer and more scientific than animal experiment. In addition, it is being specified through the legislation based on EU s guidelines and through the decision case of ECJ(Court of Justice of the European Union). As the preferential activity for animal protection, EU is applying the guidelines of prohibiting animal experiment to the field of cosmetics. This study is aimed to consider the contents pertinent to the legal development of animal protection in EU and to the ban on animal testing in the field of cosmetics focusing on the guidelines enacted by the EU institution and on the decision case in ECJ.
