인천의 공유자산과 인천시의 도시정책

국문 초록

한 국가나 도시에 있어 공공재산이든 사유재산이든 모든 자산은 공유재 또는 공유자산, 즉 커먼즈(commons)의 관점에서 접근하여 많은 사람들이 지속적인 혜택을 볼 수 있도록 해야 한다. 그럼에도 불구하고 특정 권력이나 세력에 의해 사유화, 상품화 되면서 공공성을 상실해가고 있는 것이 우리의 모습이다. 이러한 상황에서 이를 막고 공유자산화(commoning)에 앞장서야 할 지자체(장)의 역할이 매우 중요해지나 오히려 이에 앞장서거나 이를 부추기는 경우가 많다. 이는 해당 자산의 소유권과 처분권이 자신들에게 있다고 보았고, 시민들도 이를 암묵적으로 인정한 탓이다. 그러나 그것은 잘못된 인식으로, 모든 자산은 사회적이고 집단적으로 생산된 것인 만큼 이에 대한 권리를 도시의 주인인 시민들이 되찾아야 한다. 이 글에서는 인천시를 중심으로 그동안 이를 어떻게 행사해 왔는지 고찰함으로써 특정 자산이 행정 권력에 의해 일방적으로 처리될 경우 어떠한 결과를 초래하는지를 확인하고, 보다 공공적인 논의와 관리 시스템이 왜 필요한 지를 환기시키고자 한다. 이를 위해 가)공유재(commons)로서의 성격을 가지고 있거나 그렇게 만들어 가야 할 공공 소유의 재산(Public Ownership)을 지자체가 어떻게 생각하고 처분 또는 활용했는가와 관련된 사례 다섯 가지, 나)공유재(commons)로서의 성격과 가치를 가지고 있는 민간 또는 개인 소유의 재산(Private Ownership)을 지자체가 어떻게 생각하고 처분 또는 활용 했는가와 관련된 사례 6가지, 다) 공유재(commons)로서의 가치와 성격을 가지고 있는 민간 또는 개인 소유의 재산을 해당 소유주가 사유화(상품화)하여 반공공적으로 활용하려 할 경우 지자체가 어떻게 생각하고 개입했는가와 관련된 사례 다섯 가지를 소개하고, 나름의 분석과 평가를 시도해 보았다. 그 결과 지자체(장)이 해당 재산의 공유적 가치에 대한 의식이 부재한 상태에서 그 소유권과 처분권을 행사하다 보니 인천의 도시공간은 공유자산의 비중과 비율이 감소하고 특정 소수의 권력과 이익을 위한 독점화와 사유화가 증대되고 있음을 확인하였다. 이에 특정 자산의 소유권과 처분권이 지자체 (장)에게 있지 않고 시민에게 있다는 점을 새삼 인식하는 가운데 이에 대한 주인으로서의 권리를 어떻게 확보하고 행사할 수 있을까를 하나의 과제로 제시하고자 한다.

영문 초록

All properties in a city or a country need to be considered commons (shared resources) whether they are public or private so that many people could enjoy continuous benefits from them. However, we face the harsh reality that publicness has been lost through privatization and commercialization by some particular power. The roles of local governments become more important than ever since they are responsible for leading the commoning (becoming common resources). Rather, they have been acting the other way around by sabotaging commoning projects. It happened because they thought that rights of the resources and disposal are upon them as citizens tacitly recognized their actions, which is mistaken because all social resources have been produced socially and collectively. Therefore, rights to the shared assets should return to the citizens. This article focuses on how local authorities have hindered the commoning process based on the cases of Incheon metropolitan city. It would reveal what results caused when administrative power voluntarily disposed of specific assets and why public discussions and management system about them are needed. In this line, this paper tried to introduce and analyse the following relevant issues its own way. First point, it deals with 5 cases that how local authorities took, thought and disposed of public ownerships that have definite nature of commons and ones supposed to be public. Second, 6 cases dealing with how local authorities took, thought and used the private ownerships that have the nature of commons. Third, 5 cases dealing with how local authorities took, reacted and intervened in private ownerships which have the nature and value of commons but whose owners tried to use on the contrary to the public cause through privatization. It turned out that the ratio of public resources had been reduced only to increase exclusivity and privatization for specific individuals in Incheon since local authorities exert their ownerships and dispose of them arbitrarily without awareness of common value of the resources. This is an another effort to present various ways to how citizens would secure and exercise the rights of commons by awakening that the rights reside with citizens.
