병원내 인권침해 사례에 대한 법적 문제

국문 초록

최근 폭언ㆍ폭행ㆍ성희롱ㆍ성폭력 등 인권을 침해하는 일체의 행위를 포함한 병원내 인권침해사례에 대한 문제와 특히 시간외근무에 대한 보상과 교육, 회의, 각종 병원 행사 참가에 따른 보상이 제대로 이뤄지지 않고 있는 등 병원의 노동현실은 매우 심각한 것으로 나타나고 있다. 본 연구에서는 사실상 인권침해라는 개념은 추상적이고 굉장히 포괄적이기 때문에 해석의 기준의 관점에서 병원내 인권침해 사례들에 대한 구체적인 범위를 정하는 것은 매우 힘들지만 일반적으로 구체적인 사례에서 법률의 보호범위 내에서 인정되고 있고 문제가 되고 있는 유형들을 나누어 주요 사례들을 중심으로 법적 한계들을 고찰하고 있다. 다음에서는 병원내 인권침해 사례에 대한 법적 문제들을 근로환경에 따른 성희롱 등 인권침해, 근로기준법 위반에 따른 인권침해, 모성보호와 관련한 인권침해에 대한 주요 사례들을 중심으로 법적 한계를 살펴보기로 한다(II). 아울러 국가가 인권을 보호하고 증진하는 일차적인 의무를 가지지만, 기업도 사회조직의 일원으로서 모든 사람의 인권을 보호, 존중, 증진하지 않으면 안 된다. 이에 따라 사용자의 조직의무강화 등 병원내 근무환경에 따른 인권침해유형에 따른 예방개선방안을 제시하고, 아울러 근로기준법을 위반한 것은 아니지만 병원의 긴축재정을 통해 노동조건의 악화와 조직의무위반으로 병원내 의료진의 근무환경을 한계상황을 몰아가는 구조적인 문제들도 포함시켜 검토하고 있다(III). 마지막으로 이러한 인권침해의 사례는 일차적으로 병원개설자의 책임을 강조하고 비용절감을 이유로 열악한 의료환경속에 자살 등의 한계상황들이 사실은 구조적인 문제에 있다는 점을 강조하고 있다(IV).

영문 초록

In recent years, there has been a problem of human rights violations in the hospitals, including all kinds of acts that violate human rights such as abuse, assault, sexual harassment, sexual violence, and especially compensation for overtime work, compensation for participation in education, The reality of the labor in hospitals is becoming very serious. In fact, the concept of human rights violation is abstract and very comprehensive, so it is very difficult to establish a specific range of human rights violations in the hospital from the standpoint of interpretation standards, but generally it is recognized within the scope of protection of laws in specific cases. The aim of the study was to divide the problematic types and examine legal limitations based on major cases. In the following, this research was analysed at the legal limitations of human rights violations in hospitals(II). In addition, although the state has a primary duty to protect and promote human rights, the hospital organizer must protect, respect, and promote the human rights of all as members of a social organization. As a result, this proposes measures to improve prevention according to the type of human rights violation according to the work environment in the hospital, such as strengthening the duty of the user, and also not violating the Labor Standards Act(III). Finally, it is suggested that the case of human rights violation emphasizes the responsibility of the hospital organizer primarily, and points out that it is a structural problem exposing limitations such as suicide of hospital worker in the poor medical environment due to cost reduction(IV).
