공동주택 선분양 계약 중도해제옵션 가치평가

국문 초록

국내 공동주택 선분양 계약에는 옵션계약이나 선도계약 성격이 내재하지만, 수분양자가 1회차 중도금을 납입한 이후에는 계약 이행의 문제가 되어 가격위험에 노출되고 있다. 본 연구는 선분양 계약의 구조적 불공정성을 해소하기 위해 수분양자가 중도해제를 선택할 수 있도록 계약구조를 변경할 것을 주장하고, 중도해제 옵션가치를 이항옵션가격결정모델을 활용해 산출했다. 연구결과 수분양자에게 납입 중도금 90%를 환급해 준다면 옵션가치는 분양가 대비 약 0.2% 수준으로 산정됐다. 본 연구는 중도금 반환비율, 금리, 시장 변동성, 분양가와 시장가의 차이 변화에 대한 옵션가치 민감도를 분석했다. 중도해제 옵션부 공동주택 선분양 계약을 통해 소비자 선택을 확대할 뿐만 아니라 밀어내기식 선분양을 억제하고 실수요자 중심 시장으로 전환할 수 있을 것이다. 향후 선분양 계약구조의 법률, 옵션가치 평가모형, 주택도시보증공사의 기능에 대한 지속적인 연구를 기대한다.

영문 초록

There are properties of option or forward contracts in pre-sale contracts of housing in Korea. Pre-sale contracts, however, are viewed as a contract fulfillment after down payment. So buyers cannot cut off their loss and take price risks until completion. This study proposes that buyers should have the option to sell the contracts, and estimates the option value using binomial option valuation model to reform the structural inequity of pre-sale contracts. The abandon option value is about 0.2% of the pre-sale price if refund rate is 90% of interim deposits. This article analyses the sensitivity of input variables such as refund rate, price volatility, premiums or discounts of pre-sale prices. These proposals will restrain the speculated pre-sales, promote consumers’ choices, bring buy-to-live end-users into focus. We expect further studies on the legal pre-sale contract structures, the option valuation model, and the roles of HUG as default option warrantor to mitigate a contingent liability and potential consequences to the Korean real estate market created by this abandon option.
