국문 초록

Hate Speech(일명 혐오적 표현)은 그로 인해 파생되는 여러 해악을 고려할 때, 어떤 방식으로든 개입이 불가피하다. 하지만 그 규제의 방향은 단순히 혐오적 표현을 ‘금지’하는 것만이 능사는 아니다. 혐오적 표현에 효과적으로 대응하기 위한 방안으로는. 가장 먼저 혐오적 표현을 ‘차별’의 일종으로 보아 차별금지법의 제정을 통해 혐오표현에 대한 규제를 주도함이 상당하다. 차별금지법을 제정하여 혐오표현의 정의와 그 규제에 대한 별도의 명확한 규정을 정하는 한편, 국가인권위원 회나 별도의 독립된 차별시정기구를 설치하여 혐오적 표현을 종합적으로 관리 감독하도록 권한을 부여해야 한다. 한편, 혐오표현을 형사범죄화 할 경우 그 적용범위를 적절히 좁혀서 남용가능성은 최소화해야 할 필요가 있다. 그 밖에도 혐오적 표현을 억제하기 위해서는 언론기관과의 협력이 중요하며 건전하고도 성숙된 시민의식의 함양을 위한 대대적 홍보와 교육도 필요하다. 결국, 혐오표 현에 대한 대응은 단순히 법적인 금지규제만이 아니라 교육과 대국민 인식개선을 통한 시민사회 성숙, 국가와 지자체, 언론기관, 시민단체 등의 유기적이고도 종합적인 대책을 모색할 때 비로소 해결이 가능할 것이다.

영문 초록

Considering various harms, the state intervention in the hate speech in any way is inevitable. However, the direction of regulation is not merely to ‘prohibit’ abhorrent expressions. In order to effectively respond to abhorrent expressions, First, it is important to lead the regulation of the expression of disgust through the enactment of the Anti - Discrimination Act as a kind of ‘discrimination’. The Anti-Discrimination Law should be enacted to establish the definition of abominable expressions and clear rules for its regulation, while authorizing the establishment of a national human rights commission or a separate independent discrimination system to supervise abusive expressions in a comprehensive manner. On the other hand, when criminalizing the expression of aversion, it is necessary to minimize the possibility of abuse by appropriately narrowing the scope of application. In addition, cooperation with media organizations is important to deter abusive expression, and massive publicity and education are needed to foster healthy and mature citizenship. In the end, the response to the expressions of disgust can be solved only when we look for organic and comprehensive countermeasures such as mature civil society, national and local governments, media organizations, and civic groups through education and improvement of public awareness, not just legal prohibition regulations.
