미군정기의 ‘우드월 헌법초안’

국문 초록

1948년 헌법제정과정에 대한 실증적 연구는 한국 헌정사연구의 큰 공백지대 중의 하나였다. 예를 들면 유진오선생이 자신의 ｢헌법기초회고록｣에서 ‘우드월 헌법초안’을 참조하였다고 언급한 바있는데, 이 헌법초안의 실체는 한국헌정사의 오랜 숙제 중의 하나였다. 그러다 마침내 2008년 고려 대학교 박물관이 펴낸 ｢현민 유진오 제헌관계 자료집 에 의해 필사본의 형태로 전격 공개되었다. ‘우드월 헌법초안’은 외견상으로는 권리장전에 관한 편장을 두고 권력분립에 대하여 규정함으 로서 ‘근대적 헌법’의 외양을 갖추고 있으나 내용상으로는 대체적으로 원활한 군정통치를 위한 범위 내에서 특정헌법사항을 선택하거나 배제하고 있다. 인권 관련하여서는 미연방헌법의 수정조항을 기초로 하면서도 국교를 부정하고 형사절차와 관련된 인권을 비교적 상세히 규정하는 한편 노동3권, 결사의 자유 등에 대하여서는 침묵하고 있으 며, 친일귀속재산처리, 농지개혁, 친일파처벌법 등 당시의 시대적 헌법과제였던 쟁점에 대하여는 외면하고 있다. 권력분립과 관련하여서는 대통령제에 기초하면서도 의회의 대통령 불신임권을 규정하고 사법부에 의한 위헌심사권을 부인하는 등 의회우위의 정부형태를 취하고 있으나, 이러한 정부형태의 전제조건인 민주주의의 측면에서는 다단계 간접선거제를 취하는 등의 방법으로 유권 자가 의회를 직접 구성하고 통제하기 어렵도록 하는 등 매우 미흡한 모습을 취하고 있다. 나아가 현대입헌주의 헌법의 주요한 내용에 해당하는 사회권, 평화주의, 위헌법률심사권, 지방자치 등을 규정하고 있지 않는 등 ‘현대적 헌법’으로서는 외양은 갖추고 있지 아니하다. 이러한 원인에 대해서는 이러한 헌법초안이 미군정에 의한 직접 점령통치를 간접 점령통치를 위한 잠정헌법안으로 생각했기 때문이라는 분석도 가능한 한편, 남한의 정치세력을 우파적으로 재편 성하여 원활한 점령통치를 도모하기 위한 이 초안의 목적 때문이었다는 분석도 가능하다 하겠다. 이상, 이 초안에 대한 연구는 몇 가지 숙제(원본 확인, 작성 시기 및 주체의 확정, 미군과 한국군 및 정부와의 관계)를 남기고 있지만, 현재까지의 사료 등에 의거할 때, 미 점령당국의 이른바 정무위원회 구상 하에 1946년 초에 미군정청의 우드월이 주관하여 만들어진 잠정적인 남한정부의 헌법초안으로 사료된다.

영문 초록

The Draft of the Constitution of Korea by Emory J. Woodall(hereafter ‘The Constitutional Draft by Woodall’) was opened to the public through ｢The Jin-0 Yoo s Document Book relating to the Establishment of Korean Constitution｣ in 2008. Nevertheless there are few constitutional analysis about this draft by Woodall .This thesis is a attempt to constitutional analysis to ‘the Constitutional Draft by Woodall’. Woodall have worked for the military government in Korea from september 1945 to July 1946 and serve the army as a director of justice from April 2 1946 to May 23 1946. ‘The Constitutional Draft by Woodall’ are estimated that it have written in this period by at least one officer led by Woodall. ‘The Constitutional Draft by Woodall’ is consist of 6 articles and 36 sections but there are over 100 of paragraph. There are three parts(bill of rights, powers of state, supplementary provision). In the bill of rights, there are lots of liberty and rights ‘emanate’ from the people, however those are well chosen and excluded for military governing. The Governmental Powers are based on the separation of powers which is consisted of the executive organ(administration), the legislative organ(legislation), the judicial organ(jurisdiction). A form of government is basically the presidential system based on indirected vote of people. But president could be nonconfidencial by legislation Powers. The representatives are indirectly elected by the people. The central administration is consist of the 1 civil administrator, 4 officers(civil, inspection, civil service officer), 11 executive departments, the provincial administrations are consist of village, town, city, province. ‘The Constitutional Draft by Woodall’ is not contemporary constitution, The Contemporary Constitution normally provide social rights, pacifism, judicial review,local self governing, but this draft does not cover those contemporary constitutional provisions. ‘The Constitutional Draft by Woodall’ is provisional constitutional bill, that is why this draft does not use the word establish but also use the word promulgate. The military Government in Korea anticipate that the plan of governing commission of korea going to be realize. Through ‘The Constitutional Draft by Woodall’, We could know the constitutional thinking and policy of Military Government in South Korea during the occupation.
