성희롱 정책결정과정을 통해서 본 유럽연합의 비공식 가버넌스

국문 초록

본 논문은 유럽연합의 정책결정과정을 성희롱정책결정을 통해서 살펴보면서 유럽연합의 정책결정에 있어서 비공식적인 가버넌스의 내용을 밝혀내는 것이 목적이다. 유럽연합의 비공식 가버넌스를 접근하는 이론은 초국가적 이익 네트워크의 행동방식과 전략이다. 초국가적 이익 네트워크는 국내에서 자신들의 정책을 추진할 때 국내 정부의 소극적 대응 혹은 반대에 부딪힐 경우 국내 정부를 통해서 정책을 추진하는 것을 포기하고 대신에 초국가기구 에서 우선 정책을 통과시킨 이후 초국가 기구의 정책이 국내에 영향을 미치 도록 하는 전략이다. 이것이 부메랑 효과이다. 유럽의 경우에는 부메랑 효과와 더불어 핑퐁 효과도 보여지는데 유럽에서 결정된 정책이 부메랑으로 국내에 다시 돌아와서 국내의 정책추진을 자극하고 다시 국내의 정책은 유럽 으로 다시 가서 더 발전된 형태의 정책을 낳는 방식이다. 유럽연합의 성희롱 정책이 유럽연합과 회원국 사이에서 부메랑 효과와 핑퐁효과를 잘 볼 수 있는 좋은 예이다. 국가에 기반한 단일 잇슈 단체와 학계 그리고 유럽연합내의 페미니스트가 결합하여 1990년대 집행위원회와 이사회의 결의 및 권고를 이끌어냈고 이것은 회원국가에 잠재적인 압력을 작용하여 회원국에서는 성희롱 관련입법을 제정하게 되었다. 다시 2002년 유럽집행위원회는 회원국들의더 진전된 법질서를 바탕으로 1976년의 동등대우 지침에 성희롱을 삽입시키 면서 개정 지침을 통과시킨다. 이 과정에서 초국가적 이익 네트워크가 중요한 역할을 하였다.

영문 초록

This paper aims to reveal the informal governance of the European Union through the decision making process of Sexual harassment policy. The theoretical framework of this work is the method of activity and the strategy of Transnational Advocacy Networks. When TANs are blocked by their national governments which are negatively responded or strongly opposed against the interest of TANS, they turn their target to an transnational organization such as EU. They perform an alliance and search for favorable insiders in EU and try to influence the policy making process of the transnational organization. The EU also needs a partner form civil society for the transnational expertise to pursue policies. For the EU, transnational expertise is essential for their policy design especially in the field of uncertainty and lacked information. This combination creates new policy advanced which will be a potential pressure to national government to legislate a new lagislation compatible to the EU s policy. This is Boomerang Effect. In Europe, with this Boomerang effect, we can notice the pingpong effect which in turn, the legislation which is a national response to European policy pushes the EU to develop policies. Sexual harassment policy of EU is a good example of this informal governance. Single issue organizations based a member states allied with other organization and academic researchers and they met favorable feminist bureaucrats in EU. They succeeded to draw European sexual harassment policy at first in the form of soft legislation eg. recommendation and resolution. This advance influenced member states governments until they made a legislation in this field. And finally in 2002 TANs pushed the EU to develop its legislation to a binding policy. EU passed a revised directive on sexual harassment.
