표준특허 남용 규제체계에 대한 연구 : 한중 FTA를 통한 보완 방안을 중심으로

국문 초록

2013년 특허전쟁이 전 세계에서 진행 중이다. 초국적 기업들은 표준화된 기술특허를 남용하여 경쟁자를 위협하고 있고, 그로 인한 피해는 소비자들에게 전가되고 있다. 금지청구권 남용, FRAND 확약 위반, 기만적 행위, 강제적 패키지 라이센싱 등으로 분류되는 표준특허 남용행위를 규제하기 위해 한국과 중국은 경쟁법 및 지적재산권법적 규제체계를 마련하고 있다. 양국의 현 규제체계는 경쟁법 과잉집행으로 인한 통상마찰 가능성, 강제실시권 행사로 인한 WTO TRIPS협정 위반 가능성 등의 문제점을 가지고 있다. 본 연구는 이에 대한 해결 방안으로 한중 FTA에 ‘객관적 입증 시 경쟁법 적용’, ‘공공의 이익을 위한 강제실시권 조항에 사전협의와 필요성 요건 추가’, ‘지적 재산권 위원회 설치’ 등의 조항을 기입하는 것을 제안한다.

영문 초록

In 2013, the global patent war is in progress. Some transnational corporations have been distorting the market competition by abusing their standard-essential patents and, in turn, consumers have ended up paying for the costs of such abuse. Korea and China rely on their own regulatory systems (e.g. competition law and intellectual property law) to regulate abuse of standard-essential patents, which include: i) abuse of injunctions; ii) a violation of FRAND commitments; iii) deceptive acts; iv) coercive package licensing. This paper finds that Korea’s and China’s regulatory systems can allow for excessive enforcement of competition law and compulsory licensing in a manner inconsistent with the WTO TRIPS Agreement. It suggests, as solutions to such problems, that the both countries discuss the following issues in the Korea-China negotiations: i) the obligation of competition authorities to objectively demonstrate anti-competitive effects; ii) prior negotiations and necessity requirements for compulsory licensing for public interest; iii) establishment of an IPR committee.
