법관 선임제에 대한 비판적 검토: 사법권 독립과 민주적 정당성을 중심으로

국문 초록

본 연구는 한국 민주주의 발전의 전제가 되는 법치주의 안정을 위하여 기존의 법관 선임제도를 비판적으로 분석하고 새로운 대안을 제시한다. 2009년부터 실시된 법학전문대학원 제도와 더불어 2022년부터 전면적으로 실시될 예정인 법조일원화는 법조인 양성 및 충원구조의 근본적인 변화를 의미한다. 그러나 법관을 임명하는 데 있어 객관적 기준이 명확하지 않기 때문에 임용 과정에서 정치적 고려 등 영향을 미치는 요소가 발생할 수 있는 가능성이 있다. 더욱이 사법부 내부의 승진구조의 변화가 동반되지 않는다면 사법관료제의 문제를 근본적으로 해결할 수 없을 것이다. 이 글에서는 법관 선임에 있어 기준이 되어야 할 원리로 사법권 독립과 민주적 정당성을 제시하고 이 두 원리에 입각하여 기존 법관 선임 및 인사제도의 한계를 검토한다. 이와 함께 일각에서 대안으로 제시하는 지역별 법관선임제도와 심급별 법관선임제도 및 법관 선거제 역시 사법권 독립과 민주적 정당성의 측면에서 한계가 있음을 지적한다. 그리고 이에 새로운 대안으로서 법조인을 대상으로 하는 추첨제와 시민검증위원회의 도입을 제안한다. 이를 통하여 사법에 대한 국민적 신뢰 회복을 도모한다.

영문 초록

The purpose of this study is to analyze the judicial selection system of South Korea and to suggest alternatives. The law school system established from 2009 and the unitary system of lawyers scheduled to be effective entirely by 2022 mean the fundamental change of judicial officers training and selection system. However, since both systems do not have a clear the objective standard at the appointing judges, there are possibilities to occur some factors such as political consideration that affect the appointment process. Moreover, the problem of jurisdiction bureaucracy could not be solved entirely if it is not accompanied by the change of the promotion system in the inside of the judiciary. This article proposes the judicial independence and the democratic legitimacy as the principles which should be the standards for the judicial selection. Based on the two principles, we review the limitations of the existing judicial selection and promotion system. In addition, we point out that the alternatives, the regional judicial selection system, the court hierarchical judicial selection system and judicial election system, also have limits from the perspectives of judicial independence and democratic legitimacy. Finally, we suggest the introduction of judicial lottery system and civil verification committee as new alternatives. As a result, it will help to restore public trust in the judiciary.
