국문 초록

오늘날 변화된 디지털 정보의 환경은 각종 사회문제들을 야기 시키고 있고, 이와 관련된 문제들을 해결하기 위한 법제도들도 변화하는 것은 당연한 일이다. 또한 디지털 증거는 개인이 사용하는 컴퓨터에서 아주 적은 저장매체에도 방대한 분량의 정보를 저장할 수 있어 저장매체의 압수에 있어 범죄와의 관련성이 있는 정보뿐만 아니라 그와 관련이 없는 수많은 사생활 비밀 자료가 포함되어 있을 수 있다. 특히 다중이 공동으로 이용하는 서버에는 하나의 저장매체나 시스템에 범죄와 관계없는 수많은 사람들의 데이터가 저장 또는 전송되는 것이 일반적인 현상이다. 결국, 디지털 증거는 비가시성, 상호독립성, 원본의 중요성, 정보의 복제가능성 및 대량성등의 특성에 적절한 형사증거법의 요건도 적절하게 고려되어야 하며, 디지털 정보의 본질적 특성에 근거하여 그 증거 가치를 다시 검증해 보는 절차적 보완이 반드시 필요하다.

영문 초록

Today, the environment of digital information is causing various social problems, so it is natural that the legal systems to solve the problems related to the digital environment are changed as well. Also, digital evidence can store vast amounts of information on personal computers and on small storage media, so that confidential information related to crime in the confiscation. It is a common phenomenon that a large number of people who are unrelated to crime are stored or transmitted to a single storage medium or a system. Ultimately, digital evidence must also properly consider the requirements of the criminal evidence law in terms of non-visibility, mutual independence, the importance of the original, the reproducibility of the information and the bulk of the information. In addition, procedural supplementation is necessary to re-examine the evidence value based on the essential characteristics of digital information.
