필리핀 재외국민의 범죄피해 실태와 보호체계 개선방안

국문 초록

이 연구에서는 필리핀 재외국민의 범죄피해 실태를 분석하고 범죄피해를 야기하는 다양한 원인들에 대한 분석을 실시하였다. 이를 통해 우리 재외국민을 안전하게 보호할 수 있도록 외교부나 경찰청 등 우리 정부에서 시급히 개선해야 할 정책적 대안을 모색하였다. 연구결과, 필리핀 재외국민의 범죄피해를 억제하기 위해서는 첫째, 필리핀에 파견하는 경찰 주재관 인력을 증원하고 설치, 운용되고 있는 코리안 데스크를 확대해야 한다. 둘째, 필리핀 경찰에 대한 지원을 확대하여 우리 재외국민 대상 범죄피해에 대한 그들의 대응 역량을 강화하고, 필리핀 사법 당국과의 공조체계를 강화하여 국내에서의 범죄행위 후 필리핀으 로 도주한 사범들에 대한 적극적 송환을 도모해야 할 것이다. 셋째, 필리핀 재외국민의 자위적 방범역량 제고를 위해 외교부 차원의 지원을 확대하여 체계적인 자율방범 네트워크가 구축될 수 있도록 하고, 현지 경찰과 공조할 수 있는 자율 방범기관을 확대시켜야 할 것이다. 넷째,「재외국민등록법」의 개정과 가칭「재외국민보호법」을 제정하여 단 17%에 그치고 있는 필리핀 재외국민들의 등록률을 향상시켜야 할 것이다. 그리고「여권법」과「여권법시행령」의 개정을 통해 여행금지 경보가 내려진 지역이나 국가에 출입국 하는 위반사범들에 대한 처벌을 강화해야 할 것이다.

영문 초록

This study conducted analysis of crime damages of Korean nationals residing in the Philippines as well as of the diverse causes of such crime damages. By doing so, the study sought to explore policy-related alternatives that need to be urgently implemented so that Korean government including the Ministry of Foreign Affairs and the National Policy Agency is able to safely protect Korean nationals residing abroad. As a result of the research, the study explored following measures in order to curb and lessen crime damages of Korean nationals residing in the Philippines. First, the government should increase the police manpower to despatched to the Philippines and expand Korean Desk established and operated there. Second, the government should expand its supports to the Philippine police so that they could reinforce their capability dealing with crime damages among Korean nationals residing there and should reinforce cooperation system with the Philippine judicial authorities so that the government could actively repatriate criminals who fled to the Philippines after committing a crime in our country. Third, in an attempt to enhance the self-defending anti-crime capability of Korean nationals residing in the Philippines, the government should expand supports in the level of the Ministry of Foreign Affairs so as to establish a systematic autonomous anti-crime network, while increasing autonomous anti-crime organizations. Fourth, the government should revise Registration of Korean Nationals Residing Abroad Act and legislate tentatively named Protection of Korean Nationals Residing Abroad Act in an effort to improve the registration rate of Korean nationals residing in the Philippines - currently marking just 17%. Along the way, the Korean government and legislators should revise Passport Act and Enforcement Ordinance of the Passport Act to strengthen the punishments for the violators of the Act and regulations who visit the areas or nations warned of travel ban.
