해양사고의 발생현황 및 처리절차에 관한 연구

국문 초록

한반도는 실질적으로 해양국가라는 지리적 특성에도 불구하고, 지금까지 해양사고에 대한 전문적인 대응에 있어서는 미흡한 실정이다. 해상에서 해양사고가 발생하면 가장 먼저 해양안전심판원이 조사와 심판을 담당하고 있다. 이러한 해양안전심판원은 개원 이래 해양사고의 조사와 심판 및 통계에 관한 공신력 있는 유일한 국가기관으로 자리 잡았으며, 최근에는 사법기관과 보험사 등에서 해양사고에 대한 민사 및 형사사건 처리와 보험금 지급과 관련하여 해양안전심판원의 재결서를 상당수 원용하고 있어 그 중요성과 책임이 가중되고 있다. 또한 해양사고에 대한 처리절차는 해양안전심판원의 해양사고에 대한 조사는 해양심판원조사관의 심판청구, 증거보전, 약식심판의 청구, 필요적 구술변론, 인정신문, 조사관의 최초진술, 증거심판주의, 자유심증주의, 불이익변경금지, 징계의 집행유예, 일사부재리 원칙 등형사소송절차와 유사한 다수의 제도를 채용하고 있다. 그러나 해양안전심판원의 행정심판이 라는 점에서 사법절차와는 본질적으로 다른 성격을 가지고 있다. 결국, 행정심판의 실효성이 확보되지 않는다면 행정심판제도는 사실상 무의미해진다. 따라서 이를 방지하기 위해 행정심판 즉, 해양안전심판원 재결의 효력 및 그 실효성 확보를 위한 추가적인 논의가 필요하다.

영문 초록

Korean Peninsula has not been sufficiently addressed in the specialized response to marine accidents despite of the geographical characteristics of the Korean peninsula as a virtually maritime state. When a marine accident occurs, Korea Maritime Safety Tribunal (KMST) is in charge of investigation and judgment. Since its opening, KMST has become the only national institution with public recognition. Recently, judicial authorities have been using KMST s decisions to deal with civil and criminal cases and claim payments for marine accidents in insurance companies, so their importance and responsibility are increasing. In addition, the KMST’s marine accident investigation is conducted in accordance with the criminal proceedings in relation to investigator’s claim, preservation of evidence, summary judgement, principle of trial by evidence, principle of free evaluation, principle of prohibition of changing disadvantage, res judicata doctrine. But KMST s administrative appeal are fundamentally different from judicial proceedings. In the end, the administrative appeal system becomes virtually meaningless if the effectiveness of administrative appeal is not secured. Therefore, in order to prevent this, it is necessary to discuss the effectiveness of the administrative appeal, that is, the decision of the KMST, and further discussions to secure its effectiveness.
