국문 초록

형법 제34조 제1항 ‘간접정범’은 이름은 정범이지만 내용은 행위의 대상이 제한·한정된 교사와 방조범을 정한 조항이다. 문헌의 다수 견해와 판례는 제목과 같이 제34조 제1항으로 처벌되는 자는 정범이라는 입장에서 제34조 제1항을 해석, 적용하고 있다. 제31조 교사와 제32조 방조는 모두 고의범인 정범이 전제된 제도이다. 그렇다면 제34조 제1항이 적용될 수 있는 것은 고의의 정범이 한 행위가 정당화 또는 면책되는 경우뿐이다. 교사, 방조라는 구성요건요소를 제31, 32조의 그것과 다른 기준으로 적용하거나 ‘이용하여’로 해석하는 것은 형법의 적용이 아니라 죄형법정주의에 반하는 법의 수정이다. 제34조 제1항은 제31조 제1항과 행위의 대상만 다른 교사 또는 제32조와 다른 방조범을 정한 조항이므로 그에 상응하는 기준이 적용되어야 한다. 제34조 제1항 ‘간접정범’이 명실상부한 정범이려면 첫째, 구성요건요소 ‘교사 또는 방조’를 삭제하고 둘째, ‘과실범으로 처벌되는 자’라는 중간행위자의 조건도 없애야 하며 셋째, “정범으로 처벌한다”로 개정되어야 한다.

영문 초록

The indirect Perpetrator is a legal institution, which, as far as is apparent, is made provision only in Korea and Germany. The same term and the same institution is determined differently in the two penal codes, and differently understood in literature. On the contrary to the German Law and other than the name, the indirect perpetrator in §34 of the Korean Penal Code becomes a form of participation. It is recognized by law only if an indirect offender instigates a criminal offense to another or provides assistance for the execution of the offense and punishes him as an incitement or aid. The person who has been instigated and helped must be not punished or punished for his negligence. The indirect perpetration in the Korean Penal Code is therefore not the same as German. Nevertheless, in jurisprudence and prevailing doctrine, it becomes, according to the standards and criteria of the German doctrine, namely, the control power of the indirect perpetrator. I try to recognize the status of the Korean indirect perpetration and to stabilize own application criteria. After this, the scale, which is widely used in jurisprudence and doctrine, is rejected ‘by another’ or ‘by the use of another.’ However, the legal criteria instigate , aid are sustained. And I proposed de lege frenda to change the heading of § 34 in the Penal Code as special participation .
