노⋅사 협상의제로서 ‘ 공영방송 공정성 확보방안’에 관한 평가 연구

국문 초록

본 연구는 2010년과 2012년에 KBS와 MBC 언론노동조합이 장기 파업 조건으로 내걸었던 ‘공영방송 공정성 확보 방안’의제의 정당성 및 합법성 문제를 평가하는데 목적을 두고 있다. 특히 1심과 달리 2심 법원의 ‘공정성 확보’가 공영방송 종사자의 근로조 건에 해당된다는 판결은 향후 공영방송 구조 및 운영에 미치는 영향이 클 것으로 예상 된다. 이러한 배경에서 본 연구는 ‘방송의 공정성’ 개념이 노⋅사간 협상 및 합의 대상이 될 수 있는 것이지, 언론노동조합이 ‘공정성’을 사측에 요구하고 합의⋅결정할 수있는 조건을 갖춘 주체인지, 언론노조가 요구하는 ‘공정성 확보방안’이 개별 공영방송 사의 경영진 수준에서 해결할 수 있는 문제인지를 검토하였다. 그 결과 다음과 같은 연구결과를 도출해 냈다. 첫째, 방송 공정성 개념은 매우 추상 적이고 다의적이어서 쉽게 합의될 수 없는 명제다. 때문에 이를 명분으로 하는 노동 조합의 파업은 ‘공정성’을 구현하기보다 노⋅사간에 갈등만 증폭시켜 장기화시킬 가능성이 높다. 둘째, 공정성 개념을 노⋅사간에 합의하여 규정하는 것은 사회 전체 의견을 다양하게 반영해야하는 공정성 개념에 도리어 반하는 것이다. 특히 언론노동조 합의 정치적 정향성에 비추어 공정성 요구는 정치적 갈등으로 변질될 가능성이 매우 높다. 셋째, 방송공정성을 요구하는 노동조합은 내부적으로 사회의 다양한 의견을 대표할 수 있는 조직이 아니고 정향성이 강한 조직이다. 때문에 공정성 문제가 정치쟁 점으로 변질될 가능성이 높다. 넷째, 공영방송의 공정성 확보는 국가, 사회, 조직, 개인에 이르기까지 여러 층위에서 다양한 방법들에 의해 구현되어야 한다. 특히 노동조 합이 요구하는 방안들은 방송법 개정 등 국가단위의 법⋅제도적 개선이 요구되어 사실상 정부를 상대로 한 정치투쟁의 성격을 띨 수밖에 없다. 결론적으로 공영방송 공정성은 노⋅사 합의에 의해 주도하는 방식이 아니라 공영방송의 내부 구조과 거버넌스 개혁을 통해 구현되는 것이 바람직하다.

영문 초록

This research aims to evaluate the legitimacy of ‘the measures to ensure the fairness of public broadcasting’ that the labor unions of KBS and MBC demanded at long-term strikes in 2010 and 2012. In particular, the appeal judgment was that ‘ensuring fairness’ falls under the working conditions of public broadcasting workers, which was different from the court’s first ruling. It would have a big impact on the structure and operation of public broadcasting in the future. With this background, this research raises following questions; whether the concept of ‘fairness of broadcasting’ can be subject to negotiation and agreement between labor and management, whether labor union is an entity with qualifications that can demand and decided ‘fairness measure of public broadcasting’, and whether ‘the measures to ensure fairness’ required by the public broadcasting media labor union is a problem that can be resolved at the executive level of individual public broadcasting stations. As a result, the following research findings were derived. First, the concept of ‘broadcasting fairness’ is a very abstract and ambiguous proposition that cannot be easily agreed. Therefore, the strikes of labor unions in the name of fairness generate conflict between labor and management and drags on rather than realizing ‘fairness’. Secondly, agreeing to and prescribing the concept of impartiality between labor and management is contrary to a fairness concept that reflects the diverse opinions of a society. Especially in light of political desirability of the media labor union, fairness demands are highly likely to become a political conflict. Thirdly, public broadcasting labor unions that demand impartiality are not the organizations that can represent diverse opinions of society. Fourth, securing the fairness of public broadcasting needs to be implemented on various layers from the national, societal, organizational, and individual levels. The measures requested by labor union should be accompanied by legal and institutional actions such as the revision of the broadcasting law. In conclusion, ‘the measures to ensure the fairness of public broadcasting’ that the labor unions demand are neither the working conditions of public broadcasting service workers nor the improvement of the fairness of public broadcasting.
