학교폭력예방을 위한 경찰제도의 개선방안

국문 초록

학교에서 발생하는 학생들을 대상으로 이루어지는 범죄나 안전사고를 예방하는 것은 헌법에서 보장하고 있는 교육받을 권리를 구현하는 가장 기본적이고 중요한 국가의 의무라고 할 것이다. 학교폭력의 발생원인은 파악하기가 어렵고 대책 마련도 쉽지 않다. 경찰의 업무상 학교폭력을 예방하고 선도할 수 있는 학교전담경찰에 의한 프로그램의 개발, 운영에는 한계가 있으므로 청소년관련 기관이나 협회 등 다른 청소년 관련 공공기관이나 민간기구와의 적극적인 연계방안을 강구함으로써 사법절차에서 해방된 학교폭력전담경찰에 대한 지속적인 관리와 교육이 이루어질 수 있도록 할 필요가 있다. 현재 학교전담경찰관은 학생대상 학교폭력예방교육을 실시하고, 등하교 캠페인, 교내순찰 등을 하며 학교폭력 발생시에는 학교단계에서는 자치위원으로 참석하여 당사자의 보호와 선도처리를 하고, 경찰단계에서는 사안의 경중에 따라 형사 및 소년 사건을 진행하게 된다. 하지만 학교폭력을 형사적 견지에서 본다면 학생들을 형사입건하여 전과자로 양산하는 부정적 효과를 기인할 수 있게 된다. 특히 학교전담경찰에 대한 신뢰는 학교와 학생, 학부모와 교사, 피해학생과 가해학생간의 신뢰감을 줄 수 있기 때문에 학교전담경찰관의 경찰권의 역량 강화는 법, 제도, 정책에 대한 정비가 우선시되어야 한다.

영문 초록

According to a report by the Foundation for Preventing Youth Violence, 17.8 percent of the country s 4 million elementary school students have been victims of school violence. The school police system was first introduced in 2005 in Busan, where a fifth of all students suffered from school violence. A recent, sharp increase in emergency 117 calls, which are designed to respond to incidents of school violence, shows how many young students still suffer from abuse or harassment at school. Despite the firm resolve of the police to fight school violence and eradicate it once and for all, the police alone may not be able to end school violence completely. School violence is a serious problem in Korea. Victims of school violence are having a hard time. Violence in schools with young people is at a high. Some pundits are worried about the degree of seriousness of school violence these days. The government is planning to operate Police in schools to prevent further school violence. I don t think school violence can be eradicated once and for all with the governmental and police measures. The nation s first school-based police have started a trial mission to help fight increasing school violence. Through a close cooperative relationship, school police officers will aid teachers who have difficulty handling such cases. This study also suggested preparing and enhancing other measures such as strengthening monitor activities of teachers and education programs designed to prevent school violence and bullying problems Under the current circumstances, we may need soft approaches instead of “tough measures” to the school violence issues.
