필지등록에 있어 지상경계 도입에 관한 연구

국문 초록

토지 소유자는 자신의 경계 위치에 따라 건물을 신축하거나 거래, 교환, 개발, 담보 등 다양한 부동산 활동을 하고 있다. 또한 본인이 보유하고 있는 토지의 위치, 면적, 권리 등에 관한 사항을 지적공부를 믿고 거래를 하고 있으나 실제 현장에서는 지적공부의 내용과 차이가 발생함으로써 발생하는 문제가 끊이지 않고 있는 상황이다. 특히, 지적도(임야도)에 표시되고 있는 경계는 실제의 위치가 다름에 따라 부동산 거래 이후 지적경계에 대한 민원발생이 해마다 증가하고 있는데 부동산 공시제도의 한 축으로서 지적공부의 신뢰에 악영향을 미치고 있다고 할 수 있다. 비록 정부는 2030년까지 지적재조사사업을 추진함으로써 지적경계의 품질을 확보한다고 추진하고 있으나 경계에 대한 정확한 이해와 이를 효율적으로 관리할 수 있는 방안 없이 추진하고 있어 앞으로도 현재와 같은 문제가 발생할 수 있다는 것은 상당히 우려스러운 일이다. 따라서 본 연구에서는 경계의 종류에 대해서 정의하고 현 도상경계의 문제점을 분석한 후 국제표준인 LADM을 활용하여 우리나라에 적합한 필지등록의 지상경계 도입방안을 제시하는데 그 목표를 두고있다.

영문 초록

The land owners have been doing the real estate activities such as transfer, development, mortgage as well as the newly built building base on the parcel boundary. Also they are conveyancing the real properties using the cadastral recording that are including the position of land, area, interests because it is very useful and reliable for land transferring in real estate market. However, the boundary surveying by the cadastral surveyor are often different between the cadastral map and real situation in reality. So it is happen to make the boundary disputes and to increase the civil complaints annually. Therefore the cadastral institute as the system of public announcement make the bad affect in society. Although the government has been implementing the cadastral resurvey project for the improving the quality of the cadastral boundary until 2030, they do not have the concept of the field boundary as well as not manage the efficient the cadastral data for being suitable the juridical cadastral institute. Thus this paper is to propose the efficient registration method and management of the field boundary for the current situation. This focus on the establishment of the clear concept about field based boundary using LADM profiles in place of the current map based boundary.
