영문 초록

The gambling means that the propeties depend on the coincidence. We can instance the casino, the game of picture cards, the horse racing, the cycling race. A lottery card is included in gambling comprehensively, Furthermore acts such as betting money on a sports game and even buying stocks can be regarded as gambling besides typical types of gambling, Under existing law system such acts which are related in gambling and a lottery ticket regards as crimes. Those are punished by criminal law. It is only exceptional when someone enjoy gambling temporarily and when the illegality is exempted by a statute . But it is true that legitimate gambling which is regarded as a exception has an obvious priority over illegal gambling which is regarded as principle. So the justice that illegal gambling has to be punished and the trust on the fairness of national law executions are challenged now. The thesis also analyzes various criminal responses to cyber gambling. In conclusion, gambling itself can not be accepted morally. But the idea that immoral act should be punished by severe criminal law at any cases seems to be very dangerous, nor is righteous. The legal solution for cybercrime is the applicable arrangement of the law to allow the search and seizure of computer as well as technical surveillance; to impose obligation to cooperate with investigating authorities; to promote the use of digital evidence and encryption; and to encourage consistent research, and training. Also, in order to deter cybercrime, international cooperation as well as the uniform legislation is critical. The thesis concludes that more feasible legislative countermeasures including criminal, social, and international actions is needed to prevent cybercrime. Moreover, it is important not only to update these countermeasure to accommodate the times and technology, but also increase the awareness among the général public. Recognition of the seriousness of cybercrime is the first step toward successful fight against such crimes.
