북극 북서항로의 국제법적 지위에 관한 연구

국문 초록

북극 북서항로는 캐나다 북극군도사이에 형성된 다양한 해로의 집합체로 구성되어 있다. 최근 지구온난화의 영향으로 북서항로에 쌓여있던 다년빙이 급격히 감소하고 있으며, 그에 따라 북서항로를 통한 국제상업용 항행이 가까운 시일내 에 가능할 것이라고 예측되고 있다. 이러한 북서항로의 환경변화는 북서항로의 법적 지위에 관한 국제적 논쟁을 다시금 일으키고 있다. 북서항로의 법적 지위에 관한 캐나다의 입장은 동 항로상의 해역이 역사적 권원에 의거한 내수라는 것이다. 만약, 동 해역이 캐나다의 주 장과 같이 캐나다의 내수가 된다면 북서항로 전체에 대하여 캐나다가 주권을 행사할 수 있으며, 동 항로를 통과하는 모든 선박과 항공기에 대하여 캐나다가 톤제권을 향유한다는 의미가 된다. 캐나다의 주장은 두 개의 법적 논거를 기반으로 하고 있는데, 첫 번째가 북서항로가 역사적 권원에 의거하여 캐나다의 내수에 포함된다는 것이다. 두 번째는 캐나다가 캐나다 북극군도 외측에 설정한 직선기선 내측에 북서항로가 존재하므로 동 항로가 캐나다의 내수에 포함된다는 것이다. 그러나 미국과 유럽연합은 캐나다의 주장이 아무런 국제법적 근거가 없다는 이유를 들어 반대하고 있다. 더 나아가 미국은 북서항로가 국제법상 국제항행용 해협에 해당하므로 자국의 선박과 항공기가 국제해양법에 따라 통과통항권을 향유 한다고 주장하고 있다. 우리나라는 북서항로의 잠재적 이용국으로서 북서항로의 법적 지위에 관하여 면밀히 검토하고, 동 항로에 대한 우리나라의 항행 이익을 확보하기 위한 노력이 필요하다. 이러한 필요성을 고려하여, 이 논문은 먼저 북서항로의 지리적 특성과 북서항로를 둘러싸고 진행되어온 캐나다와 미국 및 유럽연합간 법적 논쟁의 과정을 검토하였다. 다음으로 캐나다와 미국 및 유럽연합이 주장하는 세가지 법적 논점의 타당성에 대하여 면밀히 분석하였다. 그러한 논점으로서는 캐나다가 북극군도 내측수역에 대하여 역사적 권원이 있는가?, 캐나다가 북극군도 외측에 설정한 직선 기선이 유엔해양법협약상의 조건을 충족시키고 있는가?, 북서항로가 국제법상 인 정되고 있는 국제항행용 해협의 요건을 충족하고 있는가? 하는 점을 대상으로 하였다. 마지막으로 이상의 분석 결과를 전제로 유엔해양법협약상 분쟁해결제도내에서 동 분쟁을 해결할 수 있는 가능성에 대하여 검토하였고, 우리나라 정부가 북서항로에 대한 우리나라의 국익을 확보하기 위하여 취하여야할 조치에 대하여 몇가지 제안을 하였다.

영문 초록

The Northwest Passage consists of several possible routes through the Canadian Arctic Archipelago. As a result of global climate change, the year-round ice-coverage on the Northwest Passage has been diminishing and the amount of international commercial shipping activity is expected to increase continuously in the Passage in the near future. This circumstance makes the international community to revisit the arguments on the legal status of the Northwest Passage. Canada’s international legal position on the Northwest Passage is that the waters of the Passage are historic internal waters. It means that Canada has a sovereignty on the passage and she can control any foreign activities including navigation and overflight. It relies upon two legal bases for such position. First, the waters that make up the Northwest Passage are Canada’s internal waters by virtue of a historical title that Canada enjoys. Second, the waters are internal as they are on the landward side of strait baselines that Canada draws around the Canadian Arctic Archipelago. However, U.S. and the EU protested the Canadian claims with the view that they could not see any international legal ground to support the claims. Furthermore, US has insisted that the passage is the strait used for international navigation and that its ship and airplane can enjoy the right of transit passage in accordance with the international law of the sea. As a potential user of the Northwest Passage, we need to study the international legal issues throughly and find a way to secure our navigational right in the passage. For this end, this paper, at first, surveyed the geographical features of the Northwest Passage and the history of international legal dispute on the passage among Canada, U.S. and EU. Secondly, it examined the legitimacy of the three legal arguments of Canada and U.S. on the legal status of the passage: Whether Canada has a historic title on the waters of the Canadian Arctic Archipelago; Whether the Canadian Straight baselines around the Canadian Arctic Archipelago are satisfied with the various criteria under the UN Convention on the Law of the Sea; Whether the Northwest Passage is fulfilled the geographic and functional requirements of the strait used for international navigation under the general international law. Finally, it reviewed the possible way for the solution of the dispute within the dispute settlement system of the Convention and suggested some recommendations to the Korean Government to secure our interests on the Northwest Passage.
