국문 초록

1985년 이전에 조어도(다오우|다되는 국제써에서 중국영토임을 인정받은 역A떡 사실이 있음에도 불구하고 일본은 청일전쟁 말기에 불평등조의벤 <시모노세키조의>을 체결하여 1895년에서 1명5년간 조어도 제도를 점유하였다 <카이로선언(1 9 13)>，<포츠담선언(1명5)>과 <일본투항서(1945)>011 근거하여， 조어도 제도는 세계 2차 대전 종식 후 중국에 반환되어야 했다 하지만 냉전시작과 중국내전 및 미국의 아시아 정세 간섭으로 인하여 조어도제도는 반환되지 않았고 <샌프란시스코 대일평화조액1951 )>과 <미일간 오키나와 반환 협정(1 972)>은 국제법을 위반한 것이며， 최소한 조어도 제도 대해서는 일본과 중국긴때|는 구속력이 없다 따라서 일본은 국제법을 준수하여야 하며， 세계 2차 대전 이후 씨아 질서에 관한 구속력이 있는 국제법문건에따라 조어도 제도를 중쾌 반환해야한다

영문 초록

Historical evidence could prove it was accepted by the international community th the Diaoyu islands had been included in the territory of China before 1895. The peaceful possession of the Diaoyu islands by Japan between 1895 and 1995 is the result of the tac1ical misappropriation of the Japanese govemment at the end of Sino-Japanese War and the cession provisions of 01 Shimonoseki. According to the contents of Cairo Communiqué(1943), Potsdam Declaration(1945) and Instrument Japan ’ s Surrend쩌1945)， Diaoyu lslands should have been handovered to China immediately and unconditionally after World War 11. However, Diaoyu Islands was not returned to China in time because of Cold War, Chinese CiI War and American interference 에th As affairs. The Treαty 01 Pe，α!ce with Japaη(1 951) signed in San Francisco and ε Okinawa Reversion Treα， 1972) ate the intemational law and are not legally binding between China and Japan, at least, on the Diaoyu lslands issues. Therefore, Japan should follow the intemational law and retum Diaoyu lslands to China according to the binding intemational agreements which have established the post World War 11 order of Asia
