의원내각제 국가의 정권교체와 헌법적 책임-일본의 경우

국문 초록

최근에 대통령이 탄핵으로 인하여 권한이 정지되고 후에 탄핵결정으로 궐위되어 국무총리가 권한대행을 하는 사태가 발생하였다. 오랫동안 우리는 대통령제가 남북한 대치하는 상황에서 그 임기가 보장되어 안정된 정국을 유지하기에 적합한 최고의 통치체계로 생각해 오고 있었으나, 이번 사태로 인하여 부통령도 존재하지 않는 상태에서 비정상적인 정권교체가 발생하여 정국이 불안정 해지는 혼란을 겪으면서 보다 민주적인 정당성을 가진 제도를 생각해 보는 계기가 되었다. 그 동안 우리헌법은 이상적 형태로 의원내각제를 논의해 오고 있었던 바, 이번 기회 에서 권력의 공백이 발생할 경우, 어떻게 대처하는가를 논의하는 것은 의미 있을 것이다. 이에 의원내각제의 일반적 특징과 함께 의원내각제 국가인 일본의 헌법과 관련된 정치체제의 운영을 살펴봄으로써 의원내각제 국가의 특성을 통하여 비정상적인 지점에서 어떻게 권력교체를 해 오는지 살펴보고자 한다. 일본의 경우, 문책결의, 불신임결의, 해임결의, 사직권고결의 등을 통하여 내각과 의원에 대한 책임을 지우고 있다. 또한 의회해산을 통한 정권교체, 내각불신임을 통한 정권교체를 하고 있으며, 혼란을 막기 위해 직무대행을 미리 선정해 두고 있다. 앞으로 의원내각제의 요소에 대한 연구와 검토를 통하여 우리 정치체제의 보다 민주적인 요소가 가미되기를 바란다.

영문 초록

The President was impeached, and authority was stopped recently. So the affairs of state Prime Minister performed authority representation. I thought that the term of office was guaranteed as for the President system and maintained stable politics that of the body politic which was conformity origin, but knew that it was in an unstable condition when there was the change of government that was not normal by this situation. So a democratic system is necessary. Meanwhile, there is the need to argue when a blank of the power occurs what I should do because I consider parliamentary system as an ideal system on a constitution. To see a general characteristic of the parliamentary system and administration of the Japanese political system, I investigate the method of the power change through a characteristic of the parliamentary system. In the case of Japan, let a cabinet and a member of the Diet take responsibility through motion censuring, no-confidence motion against the Cabinet, a dismissal resolution, a resignation advice resolution. In addition, I perform the change of government through the parliamentary dissolution, change of government through the cabinet nonconfidence. In addition, duties representation is chosen beforehand to prevent confusion. You should add a democratic element through a study and examination for the parliamentary system from now on.
