국문 초록

본 연구는 한국 사회교육법의 성립 과정을 역사적으로 고찰하고자 하였다. 이를 위해 다음과 같은 연구 문제를 탐색하였다. 첫째, 각 시기별 사회교육법 성립 과정의 시대적 배경을 고찰한다. 둘째, 각 시기별로 구상된 사회교육법안의 구조 및 내용, 특징을 분석한다. 셋째, 각 시기별 사회교육법 제정을 통해 정비하려던 사회교육 체제를 분석한다. 사회교육법을 구상하는데 있어 영향을 미친 시대적 상황을 고찰하면서 다음과 같은 결과를도출할 수 있었다. 첫째, 일본의 사회교육법을 참고하여 1952년 사회교육법안을 구상했었다는그 동안의 통설은 재고되어야 한다. 둘째, 사회교육법안을 구상하는데 있어 시대적 특성과 요구를 적극 반영하려는 의도가 있었다. 셋째, 그 동안 교육에 있어 모든 중심은 학교교육에 있었 기 때문에, 상대적으로 사회교육을 제도화하는데 어려움을 겪을 수밖에 없었다. 시기별로 구상된 사회교육법은 사회적, 정치적, 타 법률 등과의 관계 속에서 다른 특징과 구조가 나타나고 있었다. 첫째, 사회교육법안은 시설을 확충하는 법적 근거를 마련하려던 것에서 평생교육 체제와의 연계를 지향한 법으로 그 특징과 구조가 변하였다. 둘째, 정부 조직의 분화에 따른 문교부 사회교육 행정 조직의 업무 축소와 정부 각 부처에 의해 추진된 사회교육 정책들은 사회교육법안의 구상은 물론, 향후 사회교육법을 제정하는데 있어 추진 동력을 떨어뜨리는 원인이 되었다. 셋째, 사회교육법을 구상함에 있어 그 성격과 구조가 전체적으로 개편되어야 하는 상황이있었다. 넷째, 정부 조직의 분화는 상대적으로 문교부 사회교육 행정의 축소로 이어져 사회교 육법안의 성격과 적용 범위가 점점 축소되었다. 법 제정을 통해 정비하려던 사회교육 체제는시기별로 다른 특징을 가지고 있었다. 특히 조건 정비는 사회교육법 제정의 핵심 과제였는데,법안을 구상하는 주체 간의 갈등도 결국 이에 대한 관점의 차이에서 나타나고 있었다.

영문 초록

This study aimed to clear up the historical transition processes of the adult & continuing education act of Korea. This study was able to derive the following output. The adult & continuing education act designed in each period had different characteristics and structures in the relation of social, political and other law. First, characteristics and structures of the adult & continuing education from arrangement of basis for expansion of facilities to the fundamental law for adult & continuing education law. Second, curtailment of service of the adult & continuing education department and the adult & continuing education policies promoted by each governmental department from differentiation of government organization caused diminishing the driving power of designing the adult & continuing education and also enactment of it henceforth. Third, characteristic and structure in designing the adult & continuing education should be totally reformed. Forth, differentiation of governmental organization relatively led to reduction of the adult & continuing education administration, and characteristics and application scope were getting downsized. The system of the adult & continuing education intended to be rearranged through the enactment of the law had different characteristics in each period. Especially, the core of the adult & continuing education act was the rearrangement of the condition, and the conflicts among the principle agents of designing act were caused by the difference in viewpoint.
