국문 초록

본 연구는 한국 영화산업의 ‘배급·상영단계의 불공정거래행위’를 분석하고 그 개선방안을 모색하고자 하는 데에 목적이 있다. 영화산업에 진출한 대기업들은 위험을 최소화하고 매출을 극대화하기 위해 영화산업 내에서 수직계열화를 추구하고, 방송과의 관계에서는 수평적 확대를 추구한다. 그 결과 산업 내에서 대기업들은 거래상 우월적 지위를 가지게 되었고, 이로 인해 불공정거래행위가 발생한다. 영화의 ‘배급·상영단계’에서 발생하는 불공정거래행위에는 부금의 조기정산 강요, 조기종영과 교차상영 등 차별적 배급과 상영, 상영을 조건으로 한 부율 변경 및 차별적 배급수수료 요구 행위, 합의없는 무료초대권 발급행위, 입장권 구입을 강요하는 행위, 상영을 조건으로 극장 내 경비나 설비제공을 강요하는 행위 등이 있다. 이러한 불공정거래행위를 개선하기 위해 산업 내 의견을 반영해 ‘표준계약서안’을 만들었지만, 표준계약서 자체만으로는 불공정거래행위에 대한 강제성을 가질 수 없다. 최소한 표준계약서가 약관화가 되어야만 공정거래위원회에서는 이를 근거로 불공정한 행위를 하는 업체에 대해 시정명령 및 과징금을 부과할 수 있기 때문이다. 또한 표준계약서의 약관화와 더불어 배급과 상영을 겸업할 수 없도록 하는 공적인 제재도 이루어져야 한다.

영문 초록

The study aims for the general analyses on the existing unfair trades mainly happening in the distribution and screening stage within the Korean film industry and to seek to gain progressive ideas for subsequent improvements. Major Companies entered in the Korean filmdom usually tend to adopt vertical systematization in order to maximize revenues while minimizing risks, and horizontal systematization for the advantageous relation with the medias. For the result of them, those corporations hold a prominent position in the cine business, so the fair dealings seldom appear recently. Most of unfair trades appear with the general features, such as coercions for early payment of dividend, discriminatory distributions and screening like early finish and irregular, unfair dividend rate alterations according to screening, demand of discriminating commissions in distribution, unapproved unilateral issue of complimentary tickets, coercions for ticket purchases, and compulsions for providence of facilities and extra charges in terms of screening. In order to eradicate those kind of unjust dealings, the Standard Contract are established according to the internal opinions of the industry, but the problem seems that the contract itself does not have any compulsory leverage for big businesses one-sided trades. Such being the case, the standard contract should be suggested into official terms and conditions in order that Fair Trade Commission(FTC) can properly impose penalties and order rectification to the companies for the unfair practices. Moreover, strong official sanctions for simultaneous all-in-one business of companies, running both distribution and screening, should be inevitable for the environmental development in the domestic film industry.
