국문 초록

인터넷망은 경제적 이익을 목적으로 하는 특정 사업자의 전유물이 아니라 모든 소비자들이 평등하게 무차별적으로 접근하여 혁신과 창조를 이루는 소통의 장이다. 그러나 인터넷망을 유지, 확장하여 소비자들이 자유롭게 이용하게 하기 위해서는 망사 업자의 지속적인 투자가 필요하다. 또한, 모든 소비자들의 합법적인 이용을 보장하고 인터넷망 자체에 대한 위해를 막기 위해서는 망사업자의 규율권한이 필요하다. 망사업자는 또한 다른 서비스, 내용, 애플리케이션을 제공하여 망자체의 효율성을 높일 수 도 있다. 이와 같은 소비자의 권리와 인터넷망사업자의 정당한 이익을 어떻게 조화시켜서 혁신과 투자, 언론의 자유를 지속할 수 있는가? 망중립성의 원칙을 유지함으로써만 가능하다는 주장에 대하여 사업자의 보다 적극적인 권리를 인정하자는 주장이 대립되고 있다. 이 글은 미국 FCC에서의 망중립성에 대한 정책논의의 연혁과 최근 진행상황을 살피고 이러한 논의가 한국의 인터넷접속사업자에 대한 정책의 설정에 어떠한 의미를 가질 것이지 살펴보기 위함이다. 저자는 현재 사업법과 약관에 명확하지 않는 망중립성 원칙을 보다 명확히 하고 사업자의 권한을 보다 제한적으로 규정한다면, 앞으로 무선접속의 폭발적 증대에 따른 망에 대한 투자필요성, 소비자를 통한 혁신가능성, 그리고 인터넷접속사업자의 결합상품에 대한 시장에서의 견제라는 정책적수요를 충족시킬 수 있을 것이라고 본다.

영문 초록

US D.C. Court revoked the FCC Camcast order on Apr. 6, 2010. The FCC, on the other hand, proposed draft rules for open internet on Oct. 22, 2009. The draft rules have been heatedly discussed among business leaders, regulators, consumers and 1st Amendment advocates. It remains to be seen how the draft rules end up with legal authorities as opposed to FCC 2005 policy invalidated by the foregoing D.C. Court decisions. Despite different views on the need to stipulate new rules on internet, many agree that innovation, investment and competition should be guideposts for internet policy. They, however, differ on the need to rein the corporate power of internet service providers. Korean internet services provides are dominated by three phone companies that maintain backbone internet network. They are aggressively pushing new business lines that can be easily linked to the internet access service with undue influence. Accordingly, the network neutrality discussions in the United States are relevant and helpful for Korean regulators to structure the policy framework for the future wireless and seamless access to internet. The current status of regulations on ISP is a far cry from internet neutrality. ISPs have unhampered discretion to control the use of consumers. A more serious problem might be their discretions are not transparent. I　argue KBC should clarify the network neutrality in the next Telecommunications and Broadcasting Combined Business Law. Furthermore, KBC should scrutinize the standard terms of the ISPs with more care and attention to protect the consumers and thereby stimulate innovations and increased investment in the network.
