골프장설치를 위한 공용수용에 대한 헌법적 평가

국문 초록

오늘날 수많은 공익사업이 공용수용의 방법으로 이루어지고 있다. 특히 사인을 위한 공용수용의 경우에는 수용당하는 개인의 기본권을 지나치게 제한할 위험성이 있다. 이러한 현재의 상황에서 먼저 공용수용이 허용되기 위한 헌법상의 요건을 알아본 후, 사인을 위한 공용수용의 경우에 추가로 필요한 요건이 무엇인지를 공용수용의 주체로서 ‘사인’의 법적 의미와 수용의 목적으로서 공공필요(공익)을 중심으로 검토하고자 한다. 다음으로 사인을 위한 공용수용의 예로서 최근의 헌법재판소의 골프장설치를 위한 공용수용 사례를 중심으로 공용수용이 허용되기 위한 헌법상의 요건의 충족 여부를 검토하였다. 2011년 헌재 결정에서 반대의견의 내용이 2014년 헌재 결정의 다수의견으로 바뀐 점, 사인을 위한 공용수용에서 ‘공공필요’의 개념을 명확히 한 점은 의미가 크다. 입법적 모색으로는 개별 법률에서 사인(경제적 사기업)의 개념을 명확히 규정하는 것이 필요하고, 헌재 결정과 논의에서 인정된 사인을 위한 공용수용의 4가지 원칙을 입법화하는 것이 필요하다.

영문 초록

Today, many utilities have been made by way of public acceptance. Especially in the case of public acceptance for an individual, there is a risk to excessively restrict rights of individuals being accepted. In this current situation, first find out the constitutional requirements for becoming public acceptance is permitted, From the perspective of public acceptance of the individual as a subject of legal and public need for the purpose of receiving, I would like to review what the requirements in addition to the common case for accommodating the individual. Then public acceptance as an example for individuals, Focusing on the public acceptance of the case for the recent installation of the Golf Course of Constitutional Court, I was reviewing whether to meet the constitutional requirements for becoming public acceptance which could be permitted. It is meant that the contents of the 2011 Constitutional Court decision dissent turned into a majority of the 2014 Constitutional Court decision and clarifying the concept of public needs of the public acceptance for an individual. From the perspective of finding the legislative way, It is need that in legislation to clearly define the concept of personal (private economy) and to enact public acceptance for the four principles recognized by the Constitutional Court decision and argument.
