중도입국청소년을 위한 청소년복지지원법의 개선방향

국문 초록

가족, 양육 그리고 청소년보호는 우리 헌법 제36조 제1항 그리고 헌법 제34조 제4항에 의하여 강하게 보호되는 우리 헌법상 중요한 가치이다. 따라서 이에 대한 보호는 헌법 제10조에 의하여 국가에게 강하게 의무 지워진다. 그리고 그 방법은 먼저 국가의 입법적 조치로부터 시작된다. 그러나 현재의 청소년복지지원법은 특히 중도입국청소년의 보호에 충분하지 않다. 이 법률의 제목을 청소년복지지원법이라고 쓰고 또 이 법 제2조 제2호에 따라 청소년복지의 의미를 “청소년이 정상적인 삶을 누릴 수 있는 기본적인 여건을 조성하고 조화롭게 성장ㆍ발달할 수 있도록 제공되는 사회적ㆍ경제적 지원”이라고 정의하고 있음에도 중도입국청소년의 물질적ㆍ경제적 복지에 관련된 근거조항은 없다. 또 중도입국청소년을 가진 가족 구성원에 대한 심리 상담이나 교육에 관한 구체적인 내용이 이 법에는 존재하지 않는다. 다문화가족의 경우 가족 구성원들은 서로 다른 문화를 가지기 때문에 이들에게 심리적인 상담은 가족의 화합을 위하여 중요한 요소이다. 또한 다문화가족이 경제적인 어려움에 빠지는 경우가 많다는 통계에 따를 때 중도입국청소년 가족에 대한 경제적 지원이 강화되어야 한다. 왜냐하면 다문화가족이 경제적으로 어려움에 직면하게 되면 이주배경청소년의 한국 적응을 위하여 가족 구성원에게 주어지는 각종 상담과 교육프로그램에 한국인 아버지나 어머니 혹은 다른 한국인 가족이 참석하는 것이 어렵거나 불가능하게 되기 때문이다. 그리고 마지막으로는 중도입국청소년들이 스스로의 힘으로 대한민국에서 생활할 수 있도록 이들에 대한 직업교육이 강화되어야 할 것이다.

영문 초록

Family, care and feeding of children and youth protection are the important values which are strongly protected under the Clause 1 of Article 36 of the Constitution and the Clause 4 of Article 34 of the Constitution. Therefore, the nation is strongly obligated for the protection of them under the Article 10 of the Constitution. And the method starts from the legislative measure of the nation first. However, the present Youth Welfare Support Act is not sufficient to protect immigrant youth. Although the title of the act is written as Youth Welfare Support Act and the meaning of youth welfare, according to No. 2 of Article 2 of this law, is defined as the social, economical support, there is no provision related with the material support and economical welfare. Moreover, there is no concrete contents in this law on the psychological counseling and education on the family members who have immigrant youths. In the case of multi-cultural families, as the family members have a different culture between them, the psychological counseling for them is an essential element for the harmony in a family. Also, given the statistics that multi-cultural families often fall in economic difficulties, the economic support on the family with immigrant youth must be enhanced, because it might be difficult and impossible for korean father and the mother of immigrant youth or other korean family members to participate in various counseling and educational programs given to the family members for the adaptation of the immigrant youth to korean society if multi-cultural families would face the economic difficulties. And, finally the vocational education should be strengthened for the immigrant youths so that they could live in Korea on their own.
