민사신탁의 위탁자 지위에 관한 연구

국문 초록

개정 전 구법에서는 [위탁자 지위의 이전] 규정이 없었고, 학설은 찬 ․ 반이 대립하고있던 반면 실무에서는 제도 도입의 필성이 제기 되었다. 그럼에도 불구하고 대법원 신탁실무 규정에서는 등기가 제한되고 있었다. 신탁에 관련된 거래당사자의 이해관계를 조정하고 신탁의 유연성(flexibility)을 확보하기 위해 위탁자 지위의 이전(상속 포함) 법률 관계를 명확히 하고자 한 개정은 의미 있다 할 것이다. 2012.7.26. 전면개정 시행된 신탁법은 민사신탁 활성화를 위해 도입된 유언대용신탁 및 수익자 연속신탁 등과 관련하여 재산소유자인 위탁자의 지위에 관해 법 제9조, 제10조에서 규정하고 있다. 기타 다양한 조문에서 신탁설정 이후 신탁종료, 해지 단계까지의 절차적 권리가 보장되어 있다. 그 이론적 기초가 민법상 계약당사자 지위 이전 법리와 유사함에도 권리, 권한 또는 권리와 의무의 총체인 신탁법 특유의 위탁자의 지위 의의를 검토하고, 그 규정의 권리 쟁점 및 조세법적 의미에 대한 해석을 정리하여 입법적 개선 필요성을 제시하고자 한다. 이 연구가 위탁자 지위의 이전에 관련된 적용 범위를 확대하고 가족 신탁, 증여신탁, 상속신탁, 후견지원신탁 등 민사신탁 분야의 활성화를 위한 마중물로서 단초 제공의 기회가 되기를 기대한다.

영문 초록

In the old law there was no amendment about the transfer of Trustor status regulations. while the scientific field was the cold, It was arisen the need for system introduction by business circle. Nevertheless, Being registered is limited by The Trust Practice regulations of the Supreme Court. The revised Trust Act for clarifying law related to the transfer of Trustor status (including inheritance) has meanings, to Adjust the interests of the parties involved in the transaction and trust, to aquire the flexibility of the amendment of the Trust Act. The revised enforcement Trust Act in korea, effective July 26, 2012 is required by law (Article 9, Article 10) about the status of the Trustor in relation to property owners as a testament to Living Trust for Will Substitute and trust beneficiaries continuously introduced for civil trust. Other Articles in The Trust Act ensure the procedural rights of creating Trust, terminating Trust, Trust cancellation, I will review unique Trustor status related to civil party status, rights, privileges or rights and obligations though similar to the transfer of contractor status as a theoretical basis in civil code. I will organize the interpretation of the rights issues and tax legal meaning of those. I propose the law need to improve. The study is expected to be an opportunity to expand the coverage related to the transfer of Trustor status and provide clues as priming for the activation of Civil trusts such as family trusts, bestowed trusts, inheritance trusts(Living Trust for Will Substitute), guardianship trusts
