국문 초록

본 연구는 경비원의 직무와 권한범위를 경비업법에 구체화하기 위해 향후 경비업법의 개정 시 입법정책에 반영하도록 그 이론적 기초 자료를 제시하는 데 목적이 있다. 현행 경비업법은 집단민원현장에서의 경비업체 및 경비원의 불법행위 근절을 주요 골자로 하여 개정이 이루어진 것으로서, 근본적으로 경비원의 위법·부당한 행위를 근절하기 위해서는 오히려 경비원의 직무와 권한범위에 대한 명확한 입법화가 선행되어야 한다. 경비원은 민간인이지만 경비구역 내에서 사람의 생명과 신체, 재산등 법익을 보호하고 위험방지예방 및 즉각적 제거를 위한 안전 활동을 수행하는 자이다. 치안 공공적 측면에서 경찰의 예방활동을 사적자치영역에서 실현함과 동시에 사인에 의한 국민의 기본권에 대한 과도한침해를 예방하기 위하여 경비업의 진입규제와 경비업자 및 경비원의의무, 그리고 그에 따른 법적 책임에 대해 경비업법에서 구현하고 있다.그러나 경비원의 기본권 침해와 위법·부당한 행위를 근절하기 위해서는 경비원의 직무와 권한범위가 구체적으로 명문화되어 있어야 한다. 따라서 경비원의 범죄예방 및 질서유지, 위험발생 방지를 위한 구 체적 직무와 권한범위에 관한 학계의 논의가 향후 경비업법 개정에 반영되어야 한다.

영문 초록

This study aims to present the theoretical data to apply the duty and the scope of authority of private security guard to Security Business Act. The existing law is revised to eradicate the illegal acts of security company and guards at the collective civil petition site, but the duty and the scope of authority of private security guard should be legalized to fundamentally stop the guards against the law. The guard is a civilian but the person that conducts security activities to prevent dangers and protect human rights such as life, body, property, etc. In terms of public order, the license regulation of security business, obligations of security company and guards and legal liabilities are embodied in Security Business Act to prevent the excessive human rights abuse by civilians like guards as well as to realize the crime prevention activities of police in the private property rights area. Therefore, the duty and the scope of authority of private security guard should become law to stop the excessive human rights abuse by security guards and academic discussion and study about it should be reflected in the revision of Security Business Act.
