국문 초록

전세계 어느 국가에서도 경찰관의 비리는 존재한다. 국민의 생명과 재산을 지키는 국민과 가장 가까운 곳에 있는 형사사법기관인 경찰관의 도덕적 자질과 역량은 임무의 특성상 무엇보다 중요하다. 경찰은 치안유지를 위한 사회간접자본의 일부이자 국가경쟁력의 핵심요소라고 할 수 있다. 경찰의 잦은 비리, 범죄행위와 이에 따른 국민들의 불신은 사회안전망 축의 매우 큰 장애요소로 남게 되며, 국가의 법 집행력을 약화시킴은 물론 법과 권위를 스스로 무너뜨리는 결과를 초래하게 된다. 이 연구에서 분석하고자 하는 미국 경찰의 비행은 아주 오래된 역사를 갖고 있으며, 비행의 빈도와 유형도 매우 다양하다. 이 연구에서는 미국경찰의 비행을 경찰위증, 근무수칙 위반(근무중 섹스, 근무중 음주, 근무중 수면, 근무중 마약), 경찰만행(police brutality), 과도한 공권력의 사용, 경찰부패로 나누어 발생한 사례와 특징을 제시하였다. 이러한 경찰의 비행에 대하여 미국 정부에서는 치안서비스의 수요자이면서 협력자인 일반국민들로부터 신뢰받는 경찰이 되기 위한 정책을 중요하게 시행하고 있다. 여기에는 지역주민으로부터 신뢰를 받기 위한 모든 정책들이 망라되어 있다. 경찰정신 재무장 교육훈련, 엄정한 신상필벌을 비롯한 조직관리의 확립, 인사행정 전반에 걸친 윤리성 제고 노력, 그리고 조직의 윤리적 분위기를 개선하기 위한 각종 프로그램 개발 등의 다양한 노력들이 포함된다.

영문 초록

The misconduct of the police officers is one of the problems of the police management. This study reviewed the misconduct of the police officials. with the case of the United States. The functions of policing are important and complicated. There is a range of the police functions entangled too vast and complicated, it is not possible to separate these functions. Police misconduct has a long and tragic history in the U. S. and a wide variety of police misconduct has occurred since the initiation of policing in the United States. Types of police misconduct in this study includes police perjury, sex on duty, sleeping on duty, drinking on duty, drugs on duty, police brutality, use of excessive and deadly force by police, police corruption. Finally, there must be serious change in the very concept of policing in our cities and towns. The first change must be to do away with the "us versus them" dynamic of police-community relations. This drawing of lines - and more, this taking of sides-only fosters racism and violence, and it needs to be altered. Police officers should be reconceptualized as pubic servants engaged in social service delivery. Notwithstanding their current paramilitary image and structure, this was the original conceptualization of the police. Officers have always been urban "helpers", providing information, directing other municipal services to areas of need, and serving as an essential neighborhood resource. Conclusionally, the police in a democratic society are accountable to the public and to the law and they should be responsive to the people they serve. At the same time, the police must be accountable to the law, and in particular their actions must conform to standards of due process and equal protection.
