국문 초록

우리나라는 1991년 상법 개정시 보험계약법 가운데 인보험에 관한 다수의 규정을 신설 또는 개정하였지만, 당시 신설 또는 개정된 조항을 포함한 일부 규정에 대해 다시 개정론이 제기되기에 이르렀다. 또 보험실무에서 중요한 비중을 차지하고 있는 질병보험 등에 관한 규정이 존재하지 않는 등, 아직도 우리나라 보험계약법은 보험환경의 변화에 제대로 대응하지 못한다는 문제점도 지적되어 왔다. 이러한 문제의식에서 여기에서는 그동안 지적된 인보험계약에 대한 개별조항의 법적 문제점에 대한 검토 및 개정의견을 제시하고자 한다. 이를 통해 보험실무에 부응하고 인보험계약 관계를 합리적이고 효율적으로 규율할 수 있도록 하는 방안을 모색하고자 한다. 이 연구에서 검토할 주된 내용은 생명보험계약에 있어서 면책사유 규정의 명확화 문제, 다른 생명보험계약의 고지의무 부과 문제, 단체보험계약에서 피보험자의 동의를 요하는가의 문제, 상해보험계약에 대한 중복보험규정의 준용문제, 질병보험계약 조항의 신설 문제에 관한 것이다.

영문 초록

In 1991, the time of commercial law revision, a great number of regulations regarding person insurance among all other insurances was newly established and reformed. However, there have been voices continuously claiming another revision on some portion of previously reformed/established contract clauses. Although, critical illness insurance plays major part in insurance field, there are no proper regulations on this type of insurance contract. As such, Korean insurance contract laws have failed to adapt properly to frequent changes m an insurance market. As a step forward to solve this problem, we would like to provide some opinion on revision/review of legal issues that may arise from person insurance clauses. We would like to seek ways to regulate person insurance contract more effectively and efficiently. Furthermore, we aim to make some significant contribution to the insurance practice. The main issues that will be reviewed through t his study can be summarized as below 1) To clarify regulation issues on exemptions from obligation of life insurance contract, 2) To analyze problematic issue on insured's to duty of disclosure of other life insurance contract, 3) To justify whether the requirement to get agreement from the insured regarding group insurance contract should be considered necessary, 4) To clarify double insurance issues on person accident insurance contract, 5) Discussion on new establishment of critical sickness insurance contract clauses.
