영문 초록

China is the first trading partner of South Korea, and concluded a free trade agreement in 2014, such that in the future, this will boost more trade and investment. As a result, this will more likely also increase the dispute between South Korea and China. New arbitration rules were enforced in the Shanghai free trade area of China as of May 1, 2014. With Shanghai having many South Korean trading companies and investment companies operating in the area, analyzing the new arbitration rules is a necessity as it is very important to prepare for future disputes. The purpose of this paper is to understand that the advanced rules has been introduced to SHIAC. Therefore, I compared the new arbitration rules of Shanghai free trade area with Chinese arbitration act and CIETAC arbitration rules. The results of this paper are as follows. A new system that Acts conservation, Emergency arbitral tribunal, Third party arbitration proceedings participation, Friendly arbitration and Small dispute proceedings has been made. South Korean trading companies and investment companies in China, through the use of such advanced arbitration rules, would be expected a more efficient dispute resolution.
