중국어선 불법조업에 대한 대응방안 연구

국문 초록

중국의 급격한 경제성장으로 중국 연안은 산업 폐기물로 오염되어 어획량이 급격히 떨어져 어장으로서의 기능이 상실되었고, 2001년 한․중 어업협정이 발효된 이후 최근에 이르기까지 수천 척의 중국 어선이 서해안 배타적경제수역(EEZ) 일대에서 불법조업을 자행하고 있다. 이러한 중국어선 불법조업 문제는 중국 정부에서 묵인하기도 하고 한편으로 방조 내지 방치하기도 한다. 우리정부에서 한․중 관계당국 간 상설 고위급 협의체 신설 추진과 총기사용 기준 완화 문제를 중국정부에 전달했지만 협의체 구성에 미온적이고 총기사용에 대한 우려만 표시했다. 중국은 1986년 어업법이 제정된 이후 중화인민공화국 농업부 어업국(渔业局, 중화인민공화국어항감독관리국 中华人民共和国渔政渔港监督管理局)에서 어업법규의 집행에 대한 감시 및 감독을 한다. 성급(省級) 어업행정주관부문 내 일부 어정관리부문은 산하의 각 관할구역을 불문하고 감시 감독원을 파견하다보니 권한과 상응하는 책임이 불명확하여 법 집행의 부패를 조장하기도 한다. 랴오닝성, 산동성 등에서 출어하는 수 천척의 중국어선 불법조업을 원천적으로 봉쇄하기 위해서는 한․중 간 외교 마찰을 빚더라도 각종 불법․위법행위에 대해 중국식 엄타(嚴打)작전으로 적극 대처하는 길이 중국어선의 불법조업을 근절하는 첩경이라 생각된다.

영문 초록

A rapid economic growth of China brought some problems coastal pollution by industrial waste, causing a dramatic downfall in fish cash. Accordingly, the coasts of the country have lost their function as fisheries. Until recently since the Korea-China Agreement on Fisheries became effective in 2001, thousands of Chinese boats have been going on illegal fishing all over Korea's Exclusive Economic Zone(EEZ) of the West Sea. The illegal fishing has been tacitly approved, implicitly aided or just let aside by the Chinese government. So, the Korean government delivered messages to the Chinese government about driving the new establishment a high-level group of conference between the concerned authorities of the two countries and alleviating regulations on the use of guns against illegal fishing. But China showed a lukewarm attitude about that establishment and just expressed concerns about the use of the weapons. Since it enacted the Fisheries Act in 1986, China has monitored and supervised the execution of laws and regulations related to fishing through its governmental agencies like the Bureau of Fishing under the Ministry of Agriculture and the Fishing Port Supervision Administration. In China, some fishery administration services of provincial level dispatch supervisors irrespective of their jurisdiction, causing uncertainty in the range of power and responsibility and sometimes promoting corruption in the execution of applicable laws and regulations. To fundamentally block up illegal fishing by thousands of Chinese boats that go out from the Liaoning and the Shandong provinces, actions like roundup operations of Chinese style against any and all illegal or law-violating acts should be a shortcut to eradicating illegal fishing by Chinese boats, even though causing diplomatic conflicts between Korea and China.
