국문 초록

우리나라의 해양사고의 대부분은 총톤수 500톤 미만인 연안선에서 발생하고 있다. 이 연구는 우리나라 연안선 선원의 승무정원, 근로시간 및 휴식시간 등에 대한 설문조사․분석과 제도적 문제점을 검토하여, 해양사고의 방지를 위한 연안선 선원의 승무기준의 문제를 도출하고 그 해결대책을 모색한다. 연안선 해양사고방지를 위한 해결대책은 여러 방향으로 모색되어야 하겠지만, 중․소형선에 대해서는 근로․휴식시간과 승무정원 규정이 없거나, 제한적으로 적용되어 구체적 타당성이 있는 인적 제도가 마련되어 있지 않고, 이것이 우리나라 다수 해양사고의 근본 원인이 되고 있다는 점에서 선원법과 선박직원법상의 근로․휴식시간 및 승무정원제도의 개선방안을 연구하였다. 이 연구의 결론으로서 첫째, 승무원 기준의 적용범위 확대, 둘째, 근로시간 및 휴식시간 기준의 적용이 배제되는 선박에 대한 당사자 간의 약정을 요구하는 것, 셋째, 승무정원 산정 결정요소와 산정 세부요령에 관한 개선개선방을 제시하였다.

영문 초록

Most of marine accidents in the Republic of Korea have been occurred in relation to the coastal ships of less than 500 gross tonnage. This study intends to reveal the key issues of seafarers' manning standards on board coastal ships in order to prevent marine accidents through questionnaire survey and analyses as well as scrutiny concerning the system of minimum safe manning, hours of work and rest, etc. for coastal ships and seek how to resolve these issues. Various resolutions may need to be sought for the prevention of marine accidents concerning coastal ships. However, with respect to small or middle sized ships there are no applicable standards of hours of work or rest and minimum safe manning or otherwise they are only partially applied so that there are no detailed reasonable system in place. In view of the fact that this has been root cause of many marine accidents, this study tried to seek the improvement on the system of hours of work and rest and safe manning standards in the Seafarers' Act and Ship Officers' Act. The conclusions of this study reveal and suggest firstly expanding the scope of application on safe manning standards, secondly requesting shipowner and seafarer to enter into contract regarding hours of work and rest even if the ships are excluded from it, thirdly improving the decisive elements of calculating manning scales and detailed criteria, etc.
