선박기인 온실가스 배출규제에 관한 국제법적 연구

국문 초록

오늘날 인류가 해결하여야 할 가장 큰 과제의 하나는 온실가스 배출에 따른 지구온난화의 피해로 세계 각지의 이상기후현상에 의한 경제 ․ 사회적 피해를 최소화하여 전 지구적 난제인 기후변화의 재앙으로부터 지구를 구하는 것이다. UN을 비롯한 국제해사기구(IMO) 역시 이러한 기후변화에 따른 국제해사부문의 온실가스 감축의 일익을 담당하고자 강제성 있는 국제협약을 탄생시키고자 여러 가지 노력을 기울여 왔다. 국제해운분야의 경제성장을 고려한 온실가스 배출 증가는 현재 2.7%에서 2050년 12-18%까지 증가할 것으로 예측되고 있다. 기후변화협약(UNFCCC)은 2012년 이전에 포스트 교토의정서 체제에 대한 구체적이고 법적구속력이 있는 구체적 이행방안을 도출하여야 한다. 2020년까지 매년 1,000억 달러의 녹색기후기금을 조성하기로 한 칸쿤합의문을 이행하여야 하며, 국제해운부문도 일정한 역할을 담당하여야 할 것으로 예상된다. IMO의 기술적 및 선박 운항 상태의 규제와 같은 강행적 성격의 협약 및 경제적 방식(MBM)의 온실가스 규제에 대한 국제법 제정 논의는 선박으로부터 배출되는 온실가스의 감축과 선박에서의 효과적인 에너지사용 방법 및 관리를 촉진하는 계기가 되었다. 그럼에도 불구하고 강행적 성격의 IMO 협약의 채택과 향후 경제적 방식의 규제 논의와 이행을 위해서는 IMO 협약과 기후변화협약(UNFCCC) 간의 원칙 충돌의 문제, 구속력 있는 국제협약 채택과 이행 문제, 개발도상국의 자금 및 기술지원의 문제, 기금조달 방법의 문제 등이 산적해 있다. 본고에서는 향후 채택될 선박으로부터 배출되는 온실가스 규제에 관한 국제협약의 내용을 살펴보고 그 이행을 위한 방법론에 관한 국제법적 접근, 경제협약으로서의 온실가스 규제의 의미와 국내법의 수용 방안 및 전망 등을 연구 제시하고자 한다.

영문 초록

One of the most interested and complicated issues in 21st century is to protect and save the earth from the natural disaster of global warming caused by GHG emission. As we know, the mankind has been absolutely an endeavor in order to minimize the economic and social impact from climate change. IMO as well as United Nations have played on the important role in the reducing GHG emission against the climate change and to establish the energy savings and efficient system in shipping industries. In accordance with Second IMO GHG study 2009, it is estimated that international shipping emitted 870 million tons of CO2, which corresponds to 2.7% of the global emissions during 2007 and would constitute between 12% and 18% of the global total CO2 emissions in 2050. UNFCCC is taking into consideration that it should be emerged from the legal instruments for practical and implementation available in Post-Kyoto. As a result of the COP 16 at Cancun in Mexico last year, the developed countries have a responsibility of collecting the 100 billion US dollar in annual to keep the agreement and maritime sectors are expected to contribute the some budgets and IMO needs to talk about the money collections. In particular, the discussions for adopting the mandatory regulations such as technical and operational standards of IMO and the various Market Based Mechanism would give a chance for IMO member States to reduce the CO2 emissions from ships and have a promotion of energy efficiency on ships. However, there are still some unsolved problems not only the conflicts and a lot of different opinions between the principle of Common But Differentiate Responsibilities(CBDR) of UNFCCC and the principle of No More Favorable Treatment(NMFT) of IMO, but also the matters of assistance for the developing countries and how to collect the fund in terms of methodology etc. The objective of this paper is to review the draft convention in terms of the international law and implementation approach and take into consideration the meaning of draft convention in terms of economic impacts and lastly how to access to this convention in order to make a domestic mandatory regulations.
