인격주의 생명윤리에서 바라본 부모됨의 의미와 보조생식술의 윤리적 의미

국문 초록

윤리적 관점에서 보조생식술을 평가한다는 것은 인간에 대한 분명한 시각을 갖는다는 것을 뜻한다. 왜냐 하면 보조생식술이 인간에 대한 인간의 행위인 관계로, 인간을 어떻게 이해하는가에 따라 보조생식술에 대한 윤리적 평가도 달라질 수 있기 때문이다. 그 이해의 차이는 이원론적-기계론적 관점과 전인적-인격주의적 관점에서 극명하게 드러난다. 이원론적-기계론적 관점에서 인간 몸의 의미ㆍ가치는 물질적ㆍ도구적 수준을 넘지 못하는 관계로, 각 사람이 자유롭게 선택한 바에 따라 얼마든지 자신의 몸을 사용할 수 있다. 그리하여 성(性)과 사랑과 혼인과 출산 등이 모두 서로 분리가 가능하고, 따라서 보조생식술은 각자가 행복을 추구하며 자율적인 선택에 의하여 얼마든지 허용되는 행위가 된다. 반면에 전인적-인격주의적 관점에서는 인간의 몸이 인간 전체에서 분리될 수 없고 인간 몸의 가치도 인간의 가치와 분리되지 않는다. 그러므로 인간의 몸은 단순히 물질이나 도구로 취급될 수 없으며 그 몸을 지닌 인간 전체의 가치에 부합하는 방식으로 대우받아야 한다. 성(性) 역시 그 사람의 가치에 맞게 이해되고 실행되어야 한다면, 성(性)은 사랑과 분리될 수 없고, 이런 사랑 안의 성(性)에서 새 생명이 탄생될 필요가 있다. 즉 성(性)-사랑-혼인-출산 등이 모두 연결되어 있다. 이런 관점에 따라, 전인적-인격주의적 관점에서 바라본 보조생식술은 출산과 성(性)ㆍ사랑을 객관적으로 분리시켜 출산의 의미에 부합하지 않는다. 뿐만 아니라 자녀는 부모와 다름 없는 인간이자 인격체로서의 가치를 지니고 있으므로 자녀를 어떤 도구처럼 취급하는 것은 부당한 일이다. 보조생식술의 과정에서 새 생명을 도구처럼 다루고, 보조생식술의 정당화 근거로 종종 제시되는 출산의 권리나 불임의 고통 등이 자녀를 권리의 대상 혹은 고통에서 벗어나기 위한 도구처럼 간주한다면 이것 역시 부당한 일이다. 만일 보조생식술이 전인적-인격주의적 관점에서 용인될 수 있으려면 두 가지 조건에 부합해야 한다. 그것은 첫째, 인간 생명을 파괴하지 않는 방법일 것, 둘째, 성(性)과 출산의 인격적 의미를 보존하는 방법일 것이다. 이런 방법일 때 보조생식술은 부부의 사랑의 행위를 출산에서 분리시키지 않고 자녀의 가치를 존중하면서 출산의 과정을 돕는 본래 의미의 의료 행위가 될 수 있을 것이다.

영문 초록

In order to examine the ethical implication of the artificial reproductive technology (hereafter referred to as ART), we need to understand what a human being is and what human person means. Since ART is a kind of human action done on human being, its ethical examination requires prior understanding of being human and the meaning of human person. There are two distinctively different approach on human being: mechanistic-dualist view and holistic-personalist view. According to mechanistic-dualist view, human body is a mere material and have an instrumental value which can be used according to its owner's free will. In this view, sexuality, marriage, and procreation are dissociated from each other, and ART is fully accepted as a result of personal choice to seek one's own happiness. However, holistic-personalist has the understanding of human person as a whole. Human body cannot be separated from the whole person and its value cannot be known separately. Human sexuality needs to receive its full attention and due respect as an intrinsic property of human person. It should be understood within the context of matrimonial covenant between man and woman and their self giving love. Since holistic-personalist understands the interconnection between sexuality, marriage, and procreation, it cannot accept ART which denies the interconnection. Child is human being and human person just like his/her parents are. The child can not be treated as a mere instrument in order to fulfill the parent's desires. The neo-conceptus should not be treated as mere instruments to exercise one's own individual rights or a way to escape from suffering of sterility. The ART should satisfy two conditions according to the holistic-personalist view: it should not destroy human life including human embryo from the very first moment of conception; it should not violate the meaning of human sexuality and procreation. With these two conditions ART can be accepted as a medical practice which helps the process of procreation in the true and proper sense.
