국문 초록

지난 2013년, 유럽 연합과 일본은 온타리오주(州)의 수혜적인 발전차액지원제도(FIT)가 WTO 규정에 위반된다는 이유로 캐나다를 제소하였다. 이 사례는 WTO가 재생 에너지 발전 부문에 관한 조치에 대해 내리는 첫 결정으로서, 상소기구(AB)가 FIT가 보조금에 해당되는지 여부에 관한 판단을 회피함으로써 투자자들과 정부들로 하여금 혼란을 더 야기하였다는 비판을 받았다. 계속해서 많은 국가들이 녹색 에너지를 통한 지속가능한 성장을 도모하고 있는 추세로 짐작하여 보았을 때, 캐나다와 같은 사례가 더욱 증가할 것이며, 녹색에너지 정책을 펼치고 있는 한국도 예외일 수 없다. 이 글은 재생 에너지가 어떻게 하면 WTO 규정에 위반되는 보조금에 해당하지 않을 수 있는지에 관하여 살펴보고, 과연 ‘고전적인’ WTO 판단기준이 재생에너지에도 그대로 적용될 수 있는지 의문을 제기한다.

영문 초록

In the Canada–Renewable Energy/Feed-In Tariff case of 2013, the European Union (EU) and Japan brought a case to the World Trade Organization (WTO) against Canada, questioning the validity of Ontario’s decision to combine a generous FIT with a LCR promoting the growth of renewable energy-related manufacturing. This case being the first one for the WTO to give a ruling on measures affecting the renewable energy generation sector, there were criticisms on how the AB avoided ruling on whether an FIT constitutes a subsidy, thereby creating uncertainty for investors in renewables and governments designing their renewable energy policies. This paper studies how the subsidy issue of FITs can be fought, and suggest the irrelevance of the current subsidy standard on green energies.
