국문 초록

우리나라도 인권 문제에 관한 관심이 커지고 있고 학생의 인권 보장을 위한 법제도적 개혁이 강력하게 요구되고 있다. 그동안 우리 공교육은 국가주의 체제와 관료주의 전통과 더불어 권위주의적인 사회와 가정의 분위기에 인하여 많은 학생은 교육의 대상 내지 통제의 대상일뿐 그들의 권리에 대해서는 전혀 배려하지 않았다. 그로 말미암아 교육현장에 많은 문제가 발생되었다. 분명 헌법과 법률에는 학생의 인권과 권리에 대하여서 많은 내용을 규정하고 있지만 현실적 적용이 되지 않은 채 교육이 전개 되어 온 것이 사실이다. 2010년 경기도 교육청이 학생인권조례를 제정, 시행한 이후 각 지방자치단체에서 조례의 형식으로 학생의 인권의 구체적으로 보장하고자 노력을 하고 있다. 그러나 학생인권조례의 제정 목적은 학생의 기본적 인권의 보장이지만, 시행초기에는 조항의 의미와 해석에 의하여 많은 논란이 있고, 지금도 긍정적 평가와 부정적 평가가 대립하고 있다. 본 논문에서 2013년에 제정된 전라북도 학생인 권조례를 중심으로 학생인권조례의 법적 쟁점부분을 검토하고, 학생인권의 구체적으로 보장하고자 하는 방안을 모색하고자 한다.

영문 초록

There is a growing concern for the issue of human rights in our country as well, and the reform of the laws and systems is strongly demanded to guarantee the human rights of students. Meanwhile, students have just been regarded as ones who should be educated or controlled due to the national public education system, bureaucratic tradition, and authoritarian social and family climate, and their rights are completely overlooked, which results in giving rise to a lot of problems with education. Obviously, the Constitution and the laws mention the rights of students including human rights in large part, but the regulations aren't applied properly at all. Since the Gyeonggido Office of Education enacted an ordinance on student rights and started to execute it in 2010, every local government has tried to legislate the same kind of ordinance to ensure the human rights of students. In fact, however, there are lots of disputes on the meaning and interpretation of the ordinances in the initial phase, though the goal of the ordinances is to guarantee the basic human rights of students, and there are still pros and cons about the ordinances. The purpose of this study was to examine legal issues on student-rights ordinance, especially Jeollabukdo's one established in 2013, in an effort to explore how to guarantee the human rights of students in detail.
