지방교육자치의 헌법적 의미

국문 초록

2010년 이후 지방자치단체장과 교육감을 주민직선으로 선출한 이래로, 끊임없이 일반지방 행정기관과 지방교육행정기관의 분리 혹은 독립을 주장하는 논쟁이 존재한다. 이것은 지방교육자치를 지방자치의 일환으로 볼 것인가, 아니면 교육의 자주성에 기반을 둔 교육기관 자치의 문제로 볼 것인가에 따른 차이에서 기인한다. 문제의 해결은 헌법 내에서 지방교육자치의 의의와 위상 및 지위를 어떻게 해석할 것인가에서 부터 출발하여야 한다. 지방교육자치는 교육에 대한 지방자치로서 중앙정부로부터의 자치이고, 지방자치의 일환으로서 인정되는 영역으로 보아야 한다. 따라서 교육의 자주성전문성정치적 중립성의 보장은 교육주체의 영역이고, 교육행정기관의 일반 행정기관으로부터의 독립과 교육의 자주성은 별개의 문제로 보아야 한다. 입법 연혁 측면에서도 교육의 자주성에 대한 인식은 건국헌법 당시부터 있었고, 이것은 현행 헌법에까지 이어져 헌법적 보장 내용으로서 존중되어야 하지만, 교육행정기관 특히 지방 교육행정기관의 분리독립과 교육의 자주성독립성정치적 중립성의 요청이 필연적으로 연결되어 있거나 지방교육행정기관의 분리독립을 전제로 하여야만 보장되는 것은 아니다. 지방교육자치제의 보장은 개념적으로 지방자치와 교육자치가 결합되어 있고, 이에 따라 지 방자치 측면에서 국민주권, 민주주의, 지방분권적 원리가 작용되어야 하고, 교육자치 측면에서 교육의 자주성, 전문성, 정치적 중립성 등이 보장되어야 한다. 따라서 교육의 자주성, 전문성, 정치적 중립성을 보장한다고 하는 것이 교육행정기관의 일반 지방행정기관으로부터의 분리독립을 전제하여야만 확보될 수 있다거나 이것이 이뤄지지 않으면 헌법상 보장하고 있는 교육의 자주성, 전문성, 정치적 중립성이 훼손되어 위헌이 된다거나 하는 것은 헌법논리에 부합하지 않는다.

영문 초록

Since a local government head and superintendent of education have been elected by direct voting in 2010, it is constantly have been presented argument that separation or independence between local administrative agency and local education administration agency. It’s result from the difference that local education autonomy is a part of local government or educational institution autonomies. A solution for problem have to find how to interpret a position of local self-government. Local education autonomy is autonomy from the central government as local self-government also have to be seen the range recognized as part of local autonomy. Therefore, it is a area of education that the guarantees of independence, professionalism and political neutrality about education. It is a different matter that independence and autonomy of education from general administrative agency. In History of the legislative aspects, awareness about independent of education have been existed by first constitution. It should be respected as Constitutional guarantees of contents. However, it is not to be guaranteed only if separation and independence of education administration agency (especially, local education administration agency) and autonomy, specialty and political neutrality of education inevitably connected. A guarantee of educational autonomy system are conceptually combined with local self-government and self-government of education. Accordingly, in terms of local government, It should be applied by a principle of national sovereignty, democracy, and decentralization. And in terms of self-governing education, it should be guaranteed by the autonomy of education, Expertise and political neutrality. Consequently, it is unconstitutional proposal that guarantee of educational independence, professionalism, and political neutrality be secured on condition that education administration agency is separated from local administrative institution. When it is not detached, it is also unconstitutional proposal that educational independence, professionalism, and Political neutrality guaranteed by the Constitution will be inconsistent with Constitutional logic.
