국문 초록

이 연구는 약물남용에 대한 처벌의 억제효과를 다룬다. 따라서 처벌의 확실성이 높을수록 약물을 적게 하는지를 검증하고자 한다. 이 연구는 기존연구의 논의대로 과연 사회유대, 도덕신념, 그리고 자기통제력과 같은 요인들을 추가할 때 처벌의 확실성의 영향력이 줄어드는지를 살펴본다. 아울러 처벌의 억제효과는 조건적이어서 사회유대, 도덕신념, 자기통제력에 따라 그 효과가 어떻게 달라지는지를 경험연구를 통해 알아본다. 여기서는 사회유대, 도덕신념, 자기통제력이 낮은 사람에 한해 처벌의 억제효과가 나타날 것이라는 잠정적 범죄자 가설과, 반대로 사회유대, 도덕신념, 자기통제력이 높은 사람에 한해 처벌의 억제효과가 나타날 것이라는 합리적 범죄자 가설을 검증하려고 한다. 7대도시 2,500명 및 약물사범 629명 등 총 3,129명을 대상으로 실시한 조사에서, 이 연구결과는 처벌의 확실성이 약물남용에 유의미한 영향력을 갖는다는 것을 발견했다. 또한 처벌의 확실성은 다른 변인들을 통제해도 유의미했으며, 아울러 처벌은 사회유대와 자기통제력이 낮은 잠재적 범죄자들에 한해서 억제효과를 갖는 것으로 나타나 잠재적 범죄자 가설을 지지했다. 하지만 여러 변인들 중에서도 도덕신념이 약물남용에 있어 가장 강한 영향력을 갖는 것으로 나타났다.

영문 초록

This study intends to test a deterrent effect of the risk of legal punishment on drug use. This study tests whether the perceived certainty of punishment can reduce the probability of drug use. This study also tests whether the effect of legal punishment is reduced when other variables such as social bonds, moral beliefs, and self-control are controlled. In addition, it tests the conditional hypotheses whether the effect of punishment depends on the characteristics of offenders such as their social bonds, moral belief, and self-control. This study tests two contrasting hypotheses : the deterrent effect of legal punishment on drug use appears when social bonds, moral belief, and self-control are low(latent criminal hypothesis) and the deterrent effect of legal punishment on drug use appears when social bonds, moral belief, and self-control are high(rational criminal hypothesis). Using data from 2,500 adults in 7 metropolitan cities and 626 drug offenders, this study tests several hypotheses. Results show that the effect of legal threat on drug use is significant and that the latent criminal hypotheses is partially supported : the perceived certainty of legal punishment can deter drug use when social bond or self-control is low. However, the results reveal that moral belief has the most strong effect on drug use. The policy implication of those results are discussed.
